RESOLUTION NO.
RESOLUTION TRANSFERING OPERATION OF
TAX INCREMENT FINANCING DISTRICTS TO THE
ROCHESTER ECONOMIC DEVELOPMENT AUTHORITY
AND TERMINATING CERTAIN MUNICIPAL DEVELOPMENT DISTRICTS
WHEREAS, the City of Rochester, Minnesota (the "City") and the Rochester Economic
Development Authority (the "EDA") have determined, in connection with the City being
reclassified from a city of the second class to a city of the first class, that it is in the best
interest of the City to transfer operation of all active tax increment financing districts to the
EDA, and for the EDA to establish all of the property formerly in the municipal development
districts heretofore created by the City pursuant to Minnesota Statutes Section 469.124 to
469.134, as economic development districts of the EDA pursuant to Minnesota Statutes,
Sections 469.090 to 469.1082, which economic development districts will have the same
geographic boundaries as the municipal development districts; and,
0 WHEREAS, the tax increment financing districts to be transferred and municipal
development districts to be terminated are identified on Exhibit "A" attached hereto.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the operation of all of the City's Tax Increment Financing Districts listed on
Exhibit "A" are hereby transferred to the EDA. Upon establishment of new economic
development districts by the EDA under the EDA Act, which have the same geographic
boundaries as the Municipal Development Districts listed on Exhibit "A", the City's Municipal
Development Districts shall be terminated.
BE IT FURTHER RESOLVED that the administration and operation of economic
development districts created under authority of Minnesota Statutes, chapter 469, is assigned to
the office of city administrator and to an assistant city administrator to be known as the
"economic development district administrator."
BE IT FURTHER RESOLVED that the economic development district administrator shall
perform the following duties and responsibilities:
1 Review and evaluate economic development district proposals, contracts, and
management reports.
• 2. Act as staff advisor to the city administrator, mayor, council, and economic
development district authority board.
3. Participate in the negotiation to buy or sell commercial and residential properties,
to rent or lease improved properties, and to relocate residences and businesses
• displaced by economic district development.
4. Supervise the preparation of a general plan for economic district development.
5. Supervise the preparation of alternative developments scherr es for the rebuilding
of sites and for rehabilitation.
6. Operate, maintain, and regulate such public facilities cons ructed in economic
development districts as the council may designate.
7. Prepare periodic status reports on activities and project , including projects
proposed and under contract.
8. Prepare and submit an annual maintenance and opera ing budget for the
administrator's office and economic development districts.
9. Seek new investments and proposals in the economic dev lopment districts by
identifying and promoting opportunities to expand current facil ties or establish new
facilities.
10. Prepare and disseminate information to the public regarding economic
development district projects and activities.
• 11. Assist the city attorney in the preparation of contracts regarding economic
development district matters; and
12. Perform related work as required.
