WHEREAS, Mei Li Cui applied for a Massage License pursuant to Chapter 115 of the
Rochester Code of Ordinances for a business to be located at 2215 Second Street S.W.,
Suite 200; and
WHEREAS, this matter came before the Common Council as a public hearing on June
20, 2011, at which time all interested parties, including the applicant and her interpreter, were
given the opportunity to provide testimony as to whether the application satisfied the
requirements of R.C.O. ch. 115; and
WHEREAS, R.C.O. §115.02, subd. 2(5) requires an applicant for a Massage License to
have a certificate from either American Massage Therapy Association or the Minnesota
Therapeutic Network in order to be exempt from municipal licensure; and,
WHEREAS, at the June 20th public hearing, the applicant, through her interpreter,
stated she did not have a certificate from either the American Massage Therapy Association or
the Minnesota Therapeutic Network; and,
WHEREAS, at the June 20th public hearing, the applicant, through her interpreter,
dkated she holds a certificate of training completion from the Oriental Medicine Institute in
America for Massage; and
WHEREAS, at the June 20th public hearing, the applicant, through her interpreter,
stated she has applied for a City of Rochester Massage License, but that she has not
completed all of the required prerequisites for licensure; and,
WHEREAS, at the June 20th public hearing, the applicant, through her interpreter,
stated she did not have any employees and that her intent was to handle the business by
herself. She had not completed the employee registration requirements of R.C.O. §115.07;
and,
WHEREAS, by a preponderance of the evidence presented at the June 20, 2011,
public hearing, it is the Council's conclusion that the applicant, Mei Li Cui, has failed to satisfy
all of the massage parlor licensing requirements found in R.C.O. ch. 115 and, as such, is not
able to receive a massage parlor license from the City of Rochester.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City of Rochester, based upon the foregoing facts, does hereby deny the
application of Mei Li Cui for a Massage License on the basis that the applicant has failed to
comply with the certificate requirement provided by R.C.O. §115.02, subd. 2(5) and has failed
to satisfy all of the prerequisites for licensure under R.C.O. ch. 115.
