HomeMy WebLinkAboutResolution No. 547-11 RESOLUTION A RESOLUTION ESTABLISHING CIVIL FINES FOR OFFENSES INITIATED BY AN ADMINISTRATIVE CITATION PURSUANT TO R.C.O. §5.05 WHEREAS, Section 5.05, subd. 1 of the Rochester Code of Ordinances ("R.C.O.") authorizes the City to issue administrative citations for violations of specific ordinances listed at R.C.O. §5.03, subd. 2; and WHEREAS, R.C.O. §5.04, subd. 3 states that the Common Council must adopt by resolution a schedule of civil fines for those offenses initiated by an administrative citation. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester as follows: 1) The City hereby establishes the fine for committing a violation of any of the administrative offenses listed at R.C.O. §5.03, subd. 2, except for the offense of Repeat Nuisance Service Calls (R.C.O. ch. 85C) and Failure to Remove Snow, Ice, Dirt and Rubbish from a Public Sidewalk (R.C.O. §72.02), in the amount designated by Minn. Stat. §169.999, subd. 5, as it may be amended from time to time; • 2) The City hereby establishes the fine for committing a violation of the offense of Repeat Nuisance Service Calls (R.C.O. ch. 85C) in the amount of $60 upon the receipt of the third Repeat Nuisance Service Call within a 365-day time period. Upon the receipt of the fourth or more Repeat Nuisance Service Call (R.C.O. ch. 85C) within a 365-day time period, an additional $60 fine for each Call in excess of three would be imposed up to a maximum fine of$300 for that time period. 3) The City hereby establishes the fine for committing a violation of the offense of Failure to Remove Snow, Ice, Dirt and Rubbish from a Public Sidewalk (R.C.O. §72.02) as follows: A. First Calendar Year Offense: $40 per incident for residential property and $60 per incident for commercial property; B. Second Calendar Year Offense: $60 per incident for residential property and $100 per incident for commercial property. C.
