WHEREAS, on January 1, 2010, as part of the final phase of the Marion Orderly
Annexation Agreement, Areas #3 and #5 were annexed to the City of Rochester; and,
WHEREAS, since that time, it has been determined that 10 parcels of land should not
have been included with that annexation as the City is unable to serve those parcels with sewer
and water services or they were not included in the orderly annexation agreement; and,
WHEREAS, Minn. Stat. §414.06 provides for the detachment of property from a
municipality; and,
WHEREAS, the City of Rochester wishes to initiate the proceeding provided in section
414.06 to detach these 10 parcels from the City of Rochester; and,
WHEREAS, eight single family dwellings, one commercial building (convenience retail
store) and a population of 19 persons are currently found upon the 10 parcels of land. There are-
no municipal improvements serving the 10 parcels; and,
WHEREAS, the boundaries and area of the 10 parcels are described on the attached
Oxhibit A. The 10 parcels are situated within a municipality and abut the municipal boundary,
are rural in character and not developed for urban residential, commercial or industrial purposes.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City agrees to the detachment of the 10 parcels identified in Exhibit A from
the boundaries of the City of Rochester and requests the State to issue an Order confirming the
detachment.
