RESOLUTION
WHEREAS, Section 77.02 of the Rochester Code of Ordinances authorizes the Common
Council to establish by resolution a fixed and quantity charge, a high strength surcharge, a
capital equalization charge, a residential charge, a monitoring charge, a hauled liquid waste
charge and a plant investment fee for connection to and use of the City of Rochester wastewater
facility.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City establish a fixed and quantity charge as follows:

The fixed charge is made per sanitary sewer connection per month. The quantity charge is per
one hundred cubic feet (Ccf).

BE IT FURTHER RESOLVED that the City establish a capital equalization charge by
taking the fixed and quantity charge, and multiplying it by 1.50.
BE IT FURTHER RESOLVED that the City establish a residential charge as follows: For
the months of January, February and March of a year, the residential charge will be based on
actual water usage. For the balance of the calendar year, the residential charge will be based
on the average monthly water usage for the period of January through March or on the actual
usage, whichever is less. In the case of a dwelling that is not connected to the sanitary sewer
system in the period of January through March of a calendar year, the monthly charge will be
based upon a minimum of six billing units (Ccf).

BE IT FURTHER RESOLVED that the City establish a hauled liquid waste charge as

If it is determined that the hauling tank waste is of a high strength, the charges as determined for
septage and portable toilet waste will be used.
BE IT FURTHER RESOLVED that the City establish a plant investment fee (PIF) upon
those developments and redevelopments that create the need for or increase the demands on
the Water Reclamation Plant. The PIF shall be established as an Equivalent Residential Unit
•(ERU) as follows:
Residential Units:
Single family homes and structures with three or fewer dwelling units will be charged one
Equivalent Residential Unit (ERU) PIF for each dwelling unit as shown in Table 1:

Multiple Dwelling Units (more than three):
Buildings containing more than three dwelling units will be charged the lesser of
• 80% of the cost of one Equivalent Residential Unit PIF for each unit.
• The per fixture unit fees shown in Table 2 times the number of installed fixture units using
the drainage fixture unit values as defined by the 2009 Minnesota Plumbing Code,
Chapter 4715.2300, subpart 3.
• A maximum PIF of 3.0 times the 2" meter PIF shown in Table 2 for non-residential
developments.

Residential Redevelopments:
Structures and uses established and legally existing on or before January 1, 2005, are exempt
from a PIF to the extent of the structure or use then existing and to the extent of the parcel of
land as it is constituted on that date. A PIF credit will be calculated for properties redeveloped
for residential use after January 1, 2005, provided that an existing structure, use and wastewater
discharge to the Water Reclamation Plant was established on or after that date. The PIF credit
will be calculated at the time of redevelopment and will be based on the property uses, meter(s)
size, or number and type of previously existing dwelling units (if applicable), and the PIF rate
from the applicable Table 1 or Table 2. No refund will be made if the calculated credit is greater
than the new PIF.
For purposes of this Resolution, the term "Residential Unit" shall included seasonal public
outdoor restroom facilities.
Non-residential Developments:
New and redeveloped non-residential developments that do not have a discharge permit from
We Water Reclamation Plant will have a Plant Investment Fee based on the size of each
installed water meter, excluding those designated by Rochester Public Utilities as being installed
as irrigation meters.
The minimum meter size will be 5/8" x 3/4" and the PIF shown below is based on 25 fixture units
as defined by the 2009 Minnesota Plumbing Code, Chapter 4715.2300, subpart 3, using the
drainage fixture unit values shown. The PIF for the 5/8" x 3/4" meter will be prorated based on
the per fixture unit fee shown and the number of installed fixture units.

Non-residential Redevelopments:
Structures and uses established and legally existing on or before January 1, 2005, are exempt

the Water Reclamation Plant was established on or after that date. When these properties are
redeveloped for non-residential use, the PIF credit will be calculated at the time of
redevelopment and will be based on the property uses, meter(s) sizes, and number and types of
previously existing dwelling units (if applicable), and the PIF rate from the applicable Table 1, 2
or 3. In the event that an existing development or redevelopment of a non-residential property
requires that a larger meter be installed, the PIF will be based on the difference in cost of the
meters in the year the change is made. No refund will be made if the PIF credit is greater than
the new PIF.
Redevelopment of Existing Buildings:
To encourage the reuse and redevelopment of existing structures in the City for residential or
non-residential use, the PIF and PIF credit shall be calculated as defined above for residential
and non-residential developments, as applicable, and shall be based on the previously existing
use(s) that existed on or after January 1, 2005. Fifty percent of the sum of the calculated PIF
amount and applicable PIF credits will be charged as the net PIF.
Mixed Use Building Development/Redevelopment:
To encourage compact, dense and sustainable use of building structures and property,
developments with a mix of both residential dwelling units and non-residential uses in the same
Ouilding, the PIF will be calculated based on these different uses. The PIF for residential portion
of the development will be calculated based on the proposed residential development use as
described above using Tables 1 or 2. The PIF for non-residential portion of the development will
be calculated based on the proposed non-residential development use and resulting meter(s)
size as described above using Table 3. The residential PIF component will be added to the non-
residential PIF component of the building. Appropriate PIF credits for redevelopment of an
existing property will be determined as described above based on the previously existing use(s)
that existed on or after January 1, 2005. Fifty percent of the sum of the calculated PIF amount
and applicable PIF credits will be charged as the net PIF for a mixed use building
development/redevelopment.
Permitted Non-residential Developments
This section applies only to the commercial and industrial developments that have industrial
discharge permits with the Water Reclamation Plant that specify the allowable flows and loads
that may be discharged. The commercial or industrial developments that have industrial
discharge permits with the Water Reclamation Plant that do not specify allowable flows and
loads that may be discharged are subject to the PIF based on water meter size as shown in
Table 3. When there is a requirement that the discharge limits be increased, a Plant Investment
Fee will be determined based on the Equivalent Residential Unit fee. These developments pay a
high strength waste surcharge on their monthly bill based on their usage, therefore the PIF will
be based on 5% of the rates determined for an ERU. Table 4 shows the unit rates that will be
used for determining the PIF:

BE IT FURTHER RESOLVED that Resolution #515-09 is hereby rescinded and no longer
in effect.
BE IT FURTHER RESOLVED that this Resolution is declared to be retroactive to January
20, 2010.
