RESOLUTION
Awarding Contract for 2023 Sidewalk and Pedestrian Ramp Improvements SE
District 4-1 - Project No. J4725, establishing Sidewalk Improvement District SE-4,
and establishing rates to be collected from 2024 to 2028.
WHEREAS, The City Council adopted the Sidewalk Improvement District Program for the
annual repair and replacement of City sidewalks on November 14, 2022; and
WHEREAS, pursuant to an advertisement for bids for the following improvement(s): 2023
Sidewalk and Pedestrian Ramp Improvements SE District 4-1 - Project No. J4725, the
following bids were received complying with the advertisement:
Ti-Zack Concrete, Inc. $1,743,489.32
Doyle Conner Co $2,126,325.30
Legends Concrete, Inc $2,291,800.00; and
WHEREAS, it appears that Ti-Zack Concrete, Inc. is the lowest responsive and
responsible bidder; and
WHEREAS, implementation of the program requires establishment of the Districts
contributing to annual repair and replacement of City sidewalks; and
WHEREAS, implementation of the program also requires establishment of the Project
Areas within Districts where annual repair and replacement of City sidewalks will be
focused; and
WHEREAS, implementation of the program also requires establishment of the rates
assessed to parcels within each District.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester
that the bid of $1,743,489.32 is hereby accepted and execution of the standard City contract
for construction with Ti-Zack Concrete, Inc., is authorized for the following approved local
improvements: 2023 Sidewalk and Pedestrian Ramp Improvements SE District 4-1 -
Project No. J4725; and
BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the
deposits made with their bids, except the deposits of the successful bidder and the next
lowest bidder, which shall be retained until the contract has been executed; and
BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days after
the contract is ready for their signature, and if not executed by them in said time, they shall
be deemed to have abandoned the same; and
BE IT FURTHER RESOLVED that Sidewalk Improvement District SE-4, shown in the
attached figure and generally described as:
Parcels within City limits starting at the northeast corner of Mayo Field, following
the CP Railroad east to City Limits, then following City Limits south and west to
Hwy 63, then following Hwy 63 north to Hwy 52, then continuing on Broadway Ave
north to 9 ST SE, then east on 9 ST SE and following the Destination Medical
Center boundary north and east back to the northeast corner of Mayo Field
is established for sidewalk replacements and repairs to be completed in 2023 and
assessed to participating parcels in the District from 2024 to 2028.
BE IT FURTHER RESOLVED that Project Area SE 4-1, shown in the attached figure and
generally described as:
Parcels within City limits starting at the northeast corner of Mayo Field, following
the CP Railroad east to 11 AVE NE, then following 11 AVE south to 4 ST SE, then
following 4 ST SE east to 13 AVE SE, then following 13 AVE SE south to 15 AVE
SE, then southeast on 15 AVE SE to Hwy 14, then west on Hwy 14 to Broadway
Ave, then north on Broadway Ave to 9 ST SE, then east on 9 ST SE and following
the Destination Medical Center boundary north and east back to the northeast
corner of Mayo Field
is established as the project are for sidewalk replacements and repairs for the 2023
construction season.
BE IT FURTHER RESOLVED that the following Olmsted County Land Used Codes will be
included in a Sidewalk Improvement District Category named “Local Public”:
Parkland
Retention Pond/Drain
Flood Control
Golf Course
Public Municipal
Public County
Public School
BE IT FURTHER RESOLVED that participating parcels in District SE-4 will be assessed at
the following annual rates from 2024 to 2028:
Residential (without sidewalk) $25.26
Local Public (without sidewalk) $25.26
Residential $48.52
Local Public $48.52
Non-Residential (without sidewalk) $141.56
Non-Residential $281.11
Non-Participating $0.00
