RESOLUTION NO. 2
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, Hartman Farms, Inc., initiated an amendment to the Rochester Urban
Service Area Land Use Plan to change the designation of 2.27 acres of land located north of the
Circle 19 Plaza Second Development & Heritage Place N.W., west of Superior Lane N.W., and
�ast of the Fox Trails and Ashland Drive N.W., from the "Low Density Residential" to the
"Industrial" land use designation; and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended the approval of the proposed amendment to the
City's "LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on July 6, 2009, on the matter of the proposed
amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the application did satisfy all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Low Density Residential" designation to the "Industrial" designation:
That part of the Northeast Quarter of Section 29, Township 107 North, Range 14
West, Olmsted County, Minnesota, more particularly described as follows:
Beginning at the northwest corner of CIRCLE 19 PLAZA SECOND according to
the official plat thereof; thence along the northerly right-of-way line of Heritage
Place N.W., North 76041'41" East, 11.07 feet; thence northerly along the existing
Rochester corporate limits, North 02°05'15" West, 203.90 feet; thence along the
• northerly line and extension thereof of Lot 2, Block 2, said CIRCLE 19 PLAZA
SECOND, North 76041'41" East, 400.58 feet; thence northwesterly along a
southwesterly boundary of SUPERIOR RIDGE TOWNHOMES REPLAT C.I.C.
NO. 207, according to the official plat thereof, North 34137'38" West, 123.68 feet;
thence South 87054'45" East, 261.34 feet; thence North 29020'57" West; 86.32
feet; thence South 60039'03" West, 238.50 feet; thence South 29020'57" East,
342.69 feet to the beginning of tangent curve concave to the southwest having a
radius of 217.00 feet; thence southeasterly along the arc of said curve through a
central angle of 14024'03", 54.54 feet to the point of beginning, containing 98,936
square feet or 2.27 acres.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained
in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
