• RESOLUTION
WHEREAS, Furlow, LLC, ("Appellant") applied for a variance (Variance #R2009-008VAR)
from the parking standards required for a proposed Incentive Development for a 24-unit
apartment building to be located at 512 Fourth Street S.W.; and,
WHEREAS, R.C.O. §65.600 requires a total number of 24 parking spaces for this
proposed development and the Appellant is able to provide only ten parking spaces; and,
WHEREAS, the Appellant seeks to decrease the required number of parking spaces from
24 to ten and seeks a variance of 14 parking spaces from the provisions of R.C.O. §65.600 in
order to do so; and,
WHEREAS, on August 26, 2009, the Rochester City Planning and Zoning Commission
approved the Appellant's variance request, but added the following condition to its approval:
The applicant must submit a signed lease with the church prior to the city council
meeting on September 9, 2009; and,
WHEREAS, the Appellant appealed the condition of approval to the Common Council
and the appeal came before the Council at its September 21, 2009, meeting w hich was
continued to September 22, 2009; and,
• WHEREAS, at the September 22"d public hearing, the Council determined there was no
explanation provided as to the need for the condition of approval. In addition, the Council
determined that if the Appellant satisfied the condition of approval, there would have been no
need for variance in the first place.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City uphold the appeal filed by Furlow, LLC, and remove the condition of
approval that was imposed upon Variance #R2009-008VAR.
