HomeMy WebLinkAboutResolution No. 444-09 RESOLUTION WHEREAS, the Common Council of the City of Rochester finds that the following situation exists: A failure of the "B"jet engine in the Cascade Creek Gas Turbine #2 which is the primary internal provider of electrical power for Rochester and is critical for the use of providing energy and system reliability during the current Adams to Chester extended transmission line outage that effects one of the two primary power supply lines for the City of Rochester. Failure of the engine jeopardizes the reliability of the,Rochester electrical system and could result in a disaster that threatens the public's health, safety and welfare. If an additional component of the system were to suffer any problem including equipment failure, weather or storm damage or isolation from a portion of the electrical grid Rochester could suffer a system wide or rotating black outs that would directly affect the ability to conduct commerce, provide medical services, provide public safety services, affect the functions of government and impact the provision of basic necessities such as heat, water, groceries and other necessities of life; and, WHEREAS, the Council finds that the situation is sudden and unforeseen, and could not have been anticipated; and,• WHEREAS, the Council finds that this situation does threaten the health, safety and welfare of the citizens of and visitors to the City of Rochester; and, WHEREAS, the Council determines this situation constitutes a "Special Emergency" under Minn. Stat. §365.37, subd. 4; and, WHEREAS, pursuant to Minn. Stat. §365.37, subd. 4, a contract may be awarded without notice or competitive bidding; and, WHEREAS, pursuant to Minn. Stat. §415.01, the City of Rochester is able to invoke the authority provided by Minn. Stat. §365.37, subd. 4 NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the situation described in this Resolution is a Special Emergency.
