BE IT RESOLVED by the Common Council of the City of Rochester that the City adopt a
personnel policy regarding Military Leave. A copy of the policy is attached.

MILITARY LEAVE
A. Military Leave
1. The City will grant a military leave of absence to any employee presenting proper
orders calling them to temporary active duty, including fer military training yeses
with a the reserve unit of the United States Army, Navy Marine Corps, Coast Guard or
a National Guard Unit for a period not exceeding fifteen (15)working days in any one
(1) calendar year.
2. An employee participating in military service tpailliRg which conflicts with his/her work
schedule and will exceed the fifteen (15) calendar days allotted for the year, has the
option to use accrued paid leave or leave without pay.
B. Request for Military Leave
The employee shall be required to submit a copy of orders or a formal statement from the
appropriate military commander to the appropriate department head, as evidence of the
employee being called to duty/training }e the appropriate rdepai:tment head The orders or
statement must be attached to a "Report of Personnel Action" form requesting military
leave. The rep„vest must he and submitted to the Human Resources Department for
approval as soon as after the employee is aware of the scheduled date of the duty/training
requirements asis pessible
• C. Payment
Full Employees who have heap eMpleyed by the riff,fer at least six (6) mopthS
preGed;R0 a Gall to sep.4Ge whe are members of the National Guard, or other reserve
component of the military or Naval forces shall receive their regular scheduled City pay
when they are engaged with such organization or component in training or active service
ordered or authorized by proper authority pursuant to law, whether for state or federal
purposes, but not exceeding a total of fifteen (15)working days in any calendar year.
D. Emergencies
When an employee is ordered to duty as the result of emergency, declared by state or
federal authorities, a "Report of Personnel Action"form is not required unless the time-off
exceeds two (2) calendar weeks.
E. Retirement Contributions
When an employee is called to temporary active duty beyond the fifteen (15) working days
in any one (1) calendar year, he/she may make contributions to Public Employee's
Retirement Association for that period of time beyond those fifteen (15) days when he/she
was not receiving regular pay from the City. The amount of contributions would be equal to
the same as if the employee had been working and the City will make its normal
contributions.
