RESOLUTION
WHEREAS, pursuant to proper notice duly given as required by law,the Common Council met on the 16th
day of November, 2009, for the purpose of considering the proposed assessment of the following improvement(s);
Miscellaneous Assessments for Weed Removal, Snow Removal,Debris Removal,Tree Removal,Impound
Towing, Sidewalk Repair,and Delinquent Sewer/Water Charges and hearing and passing upon all objection
thereto; and,
WHEREAS, the Council heard all testimony. They adopted all assessments with the exception of Paul
Schauer,2431 Parkview Lane S.E. on a tree removal assessment,Anne Liwigs,3945 Tenth Avenue N.W. on an
electric/sewer/water assessment,and reduction of sidewalk assessment for Mark Hocken,4219 22"d Avenue N.E.
from $206.77 to$103.38.
NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota:
Such proposed assessment,a copy of which is attached hereto and made a part hereof, is hereby accepted and
shall constitute the special assessment against the lands described therein, and each tract of land therein included is
hereby found to be benefited by the proposed improvement(s)in the amount of the assessment levied against it.
Such assessment shall be payable in equal annual installments extending over a period of five(5)years,the
first of the installments to be payable on the first Monday in January, 2010 and shall bear interest at the rate of six (6)
percent per annum from the date of this resolution until December 31,2010. To each subsequent installment when due
shall be added interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the assessment to the County
Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City
• Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of
this resolution. He may thereafter pay to the County Treasurer the installment and interest in process of collection on
the current tax list, and he may pay the remaining principal balance of the assessment to the City Treasurer.
The City Clerk shall file the assessment rolls pertaining to this assessment in her office and shall certify
annually to the County Auditor on or before October 1 Oth of each year the total amount of installments and interest
which are to become due in the following year on the assessment on each parcel of land included in the assessment
roll.
The City Clerk shall file for recording with the Olmsted County Recorder a certified statement containing the
legal description of the affected properties and the amount of the assessment deferred on it.
