HomeMy WebLinkAboutResolution No. 062-04 RESOLUTION WHEREAS, Rochester Code of Ordinances (R.C.O.) section 71.07, subdivision 1 prohibits the construction of a driveway wider than 32 feet at the sidewalk line; and, WHEREAS, R.C.O. §71.07, subd. 2 allows the Common Council of the City of Rochester. •to waive the above width restrictions upon a favorable recommendation from the Director of Public Services if the Council determines that the wider width can safely accommodate entrance and egress of large vehicles or heavy volumes of traffic; and, WHEREAS, Courtesy Corporation (owners of the local McDonalds Restaurants) requested a 36-foot driveway width for its Second Street property (1503 Second Street S.W.) for their relocated driveway onto Second Street; and, WHEREAS, the Director of Public Works gave a favorable recommendation for a 36-foot driveway at this location; and, WHEREAS, the Common Council has determined that a 36-foot wide driveway can safely accommodate entrance and egress of large vehicles or heavy volumes of traffic. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the Council finds the conditions listed at R.C.O. §71.07, subd. 2 to have been satisfied in the case of the request of Courtesy Corporation for a 36-foot driveway width for the access serving the McDonalds Restaurant located at 1503 Second Street S.W. BE IT FURTHER RESOLVED that the approved driveway shall not exceed 36 feet in width. PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS DAY OF , 2004.
