HomeMy WebLinkAboutResolution No. 069-04 777777 M RESOLUTION WHEREAS, Elton Hills Plaza West LLC, applied for a Type III, Phase II, Special District Amendment Final Site Development Plan#03-06 to allow the construction of a 6,844 square foot building for retail uses. The property is located within the 41st Street Business Park and is zoned SD-1 (Arboretum Special District). The property is located north of 41st Street N.W., west of 315t Avenue N.W., and is platted as Lot 3, Block 1, 41st Street Business Park; and, WHEREAS, R.C.O. §§61.146, 62.708 provide the criteria for the review of this request; and, WHEREAS, the Planning Department staff recommended the following findings of fact for this application: Final Development Plan Criteria: a) Public Facility Design: An approved grading/drainage plan is required prior to construction. Approved construction plans will be required for any public infrastructure improvements. b) Geologic Hazard: There are no known geologic hazards on this • site. c) Access Effect: This property will be served by a private road system circulating through the Project Development Plan site, which will access public roads at 31st Avenue. and 41st Street. d) Pedestrian Circulation: The applicant is responsible to construct 5' wide concrete sidewalk along the entire frontage of 31St Avenue. N.W., concurrent with development of the property. e) Foundation and Site Plantings: The Final Site Plan includes proposed landscaping. Landscaping includes sod with trees located along the perimeter of the site as well as internally. f) Site Status: An approved grading/drainage plan is required prior to construction. If extension of public utilities is proposed, approved construction plans, easements and execution of a City-Owner Contract will be required prior to issuance of development permits. g) Screening and Bufferyards: The Final Site Plan includes proposed landscaping. An open drainage channel was identified on the Project Development Plan, through the site along with a 100' wide open space buffer area adjacent to the existing residential dwellings. Plantings on the berm are in place. Additional plantings • i are required along the south boundary of Outlot A (location of the • berm and drainage area). h) Final Building Design: The shape of the building has been modified slightly, and parking lot design was previously modified with approval of the office building directly to the west. A shared drive isle and parking spaces will be located between the two buildings. i) Internal Circulation Areas: Plans for off-street parking and loading areas and circulation aisles appear to meet ordinance requirements in terms of design. j) Ordinance Requirements: It appears as though the parking lot design may need slight adjustments to meet the minimum parking lot facility design standards of Section 63.450. WHEREAS, on January 14, 2004, the Rochester Planning and Zoning Commission held a public hearing on the proposed amendment, reviewed the application according to the requirements of the above-named ordinances, adopted the Planning Department recommended findings of fact, and recommended approval subject to the compliance with the following conditions: 1. Inadequate information was submitted to determine proper size of water . service for this building. Prior to issuance of permits for construction (i.e. footings, or full permit), construction plans must be approved and the RPU Water shall approve water service design for this building. 2. An approved grading/drainage plan is required prior to development of the property. A Storm Water Management fee will apply for the benefit of participation in the City's Storm Water Management Plan (SWMP), as specified in the Development Agreement. 3. Construction of a five-foot wide concrete sidewalk is required along the entire frontage of 31 st Avenue, concurrent with development of this parcel. 4. A new City-Owner contract will be required prior to the construction of any public infrastructure that was NOT included in the approved plans for the prior City-Owner contract for basic construction in 41 st Street Business Park. WHEREAS, the Common Council held a public hearing on the Final Site Plan Amendment request on February 2, 2004, and permitted all interested persons to be heard, and, • 2 WHEREAS, following the hearing, the Council concluded that the request for Special Wistrict Amendment Final Site Development Plan #03-06 satisfied the provisions of R.C.O. §§ 61.146 and 62.708 if the applicant satisfied the above four conditions. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the Special District Amendment Final Site Development Plan requested by D & B, Inc., (identified in the records of the Consolidated Planning Department as Special District Amendment Final Site Development Plan No. 03-06) is granted, subject to the above four conditions.
