• RESOLUTION
WHEREAS, D & B, Inc., applied for a Type III, Phase II, Special District Amendment Final
Site Development Plan #03-05 to allow the construction of a new Snappy Stop fast food
restaurant. The property is located within the Northwest Plaza Development and is zoned SD-1
(Arboretum Special District). The property is located along the south side of 55th Street, east of
the Merchants National Bank and west of the Affinity Plus Credit Union; and, _
WHEREAS, R.C.O. §§61.146, 62.708 provide the criteria for the review of this request;
and,
WHEREAS, the Planning Department staff recommended the following findings of fact for
this application:
Final Development Plan Criteria:
a) Public Facility Design: An approved grading/drainage plan is
required prior to construction. If extension of public utilities is
require, approved construction plans, easements and execution of
a City-Owner Contract will also be required.
b) Geologic Hazard: There are no known geologic hazards on this
site.
c) Access Effect: Access to this property is from within an internal
private road system serving the Northwest Plaza development.
d) Pedestrian Circulation: There is an existing pedestrian trail within
the right-of-way of CR 22.
e) Foundation and Site Plantings: A landscape plan for the site has
been prepared which identifies turf, shrubs, and trees on-site. The
proposed site plan proposes driving lanes up to the east and west
property lines. As a result, the site design does not provide
opportunity for landscaping along the sides of the lots.
fl Site Status: If construction of public infrastructure is required for
this project, approved construction plans and execution of an
Owner Contract will be required.
g) Screening and Bufferyards: The landscape plan includes turf,
trees and shrubs. The proposed site plan proposes driving lanes
up to the east and west property lines. This site design does not
provide an opportunity for landscaping along the side lot lines.

h) Final Building Design: The preliminary plan did not include
• building elevations to use as a comparison.
i) Internal Circulation Areas: This Plan proposes one inbound lane
and two outbound lanes. Access is to an internal private road
system serving the Northwest Plaza development. The majority of
the frontage of this property is dominated by access openings. To
minimize potential conflicts with this design, the applicant should
consider narrowing the exit lanes to the width needed for one
vehicle instead of two, as shown.
j) Ordinance Requirements: Modifications to the site design should
be considered to keep the development of this roperty in
character with other lots developed directly south of 55 h St. in this
Special District, and also to minimize potential conflicts in travel
patterns. No on-site parking is provided. The application suggest
there is a parking agreement with a neighboring property for the
required employee parking.
WHEREAS, on January 14, 2004, the Rochester Planning and Zoning Commission held
a public hearing on the proposed amendment, reviewed the application according to the
requirements of the above-named ordinances, adopted the Planning Department recommended
findings of fact, and recommended approval subject to the compliance with the following
•conditions:
1. The Site Plan shall be modified to a) add a minimum of 10' in width to the
Lot, to provide a minimum of 5' along the east and west sides of the lot
which would be landscaped with a combination of sod, shrubs and/or
trees and b) to narrow the exit lanes to the width needed for one lane of
traffic.
2. This property shall be re-platted prior to issuance of development permits.
3. An approved grading/drainage plan is required prior to construction.
Storm Water Management must be provided, and a fee will apply for any
areas of this property that do not drain to a privately constructed detention
facility previously constructed to serve this development.
4. The applicant shall provide the Planning Department with documentation
for off-site parking arrangements for employees.
5. Water service was not identified on the Plan. Water service shall be
provided per the requirements of Rochester Public Utilities, Water
Division.

WHEREAS, the Common Council held a public hearing on the Final Site Plan
Amendment request on February 2, 2004, and permitted all interested persons to be heard, and,
WHEREAS, at the February 2"d public hearing, it was determined that there is no legal
requirement in support of the first condition and, accordingly, it should be deleted; and,
WHEREAS, following the hearing, the Council concluded that the request for Special
District Amendment Final Site Development Plan #03-05 satisfied the provisions of R.C.O. §§
61.146 and 62.708 if the applicant satisfied the above four conditions (#2 -#5).
i NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the Special District Amendment Final Site Development Plan requested by D &
B, Inc., (identified in the records of the Consolidated Planning Department as Special District
Amendment Final Site Development Plan No. 03-05) is granted, subject to the above four
conditions (#2 -#5).
