RESOLUTION
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, Robert Sawinski initiated an amendment to the Rochester Urban Service
Area Land Use Plan to change the land use plan designation for property located east of the
Highway 52 East Frontage Road, north of 26th Street N.W., and south of 30th Place N.W. The
*applicant seeks to change the property's land use plan designation from the "Low Density
Residential" designation to the "Medium Density Residential" designation; and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended the denial of the proposed amendment to the City's
"LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on March 15, 2004, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Low Density Residential" designation to the "Medium Density Residential"
designation:
The East One Half of Lot Twenty (20) Allendale Subdivision of SW 1/4, Section
22, Town 107, Range 14, Olmsted County, Minnesota, according to the plat
• thereof on file in the County Recorder's Office, Olmsted County, Minnesota.

That part of Lot 20, ALLENDALE, according to the recorded plat thereof on file
j and of record in the Office of the County Recorder, Olmsted County, Minnesota,
described as follows:
Commencing at the southeast corner of said Lot 20, thence South 89047'09"
West, along the south line of Lot 20, a distance of 357.22 feet to the point of
beginning; thence, continuing along the south line, South 89047'09" West a
distance of 45.52 feet to the southwest corner of the East half of said Lot 20;
thence North 16040'18" West, along the west line of said East Half, a distance of
24.75 feet; thence southeasterly a distance of 59.42 feet along a curve not
tangential with the last described line, said curve is concave to the northeast, has
a radius of 70.00 feet, a central angle of 48037'57", and the chord of said curve
bears South 65°53'52" East, to the point of beginning.
Said Parcel contains 1.90 acres, more or less.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained
in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
Ocopy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
