HomeMy WebLinkAboutResolution No. 177-04 • RESOLUTION WHEREAS, on October 19, 1998, the City approved the Scenic Oaks First Subdivision with a parkland dedication requirement of 3.11 acres in the form of deferred land dedication of a neighborhood park as identified in the General Development Plan; and WHEREAS, on April 1, 2002, the City approved the Scenic Oaks Second Subdivision with a parkland dedication requirement of .85 acres in the form of a deferred land dedication of a neighborhood park as identified in the General Development Plan; and, WHEREAS, the original developers of the Scenic Oaks Subdivision have sold the undeveloped portions of the development including the 4 acre neighborhood park; and, WHEREAS, the new owners desire the parkland dedication requirements for Scenic Oaks First and Second Subdivisions be amended to reflect cash in lieu of land; and, WHEREAS, the City is agreeable to amend the parkland dedication requirements for Scenic Oaks First and Second Subdivisions be amended to reflect cash in lieu of land. • NOW, THEREFORE BE IT RESOLVED, that the Common Council of the City of Rochester that the parkland dedication requirement for Scenic Oaks First Subdivision will be cash in lieu of land (in the amount of $46,640) and the parkland dedication requirement for Scenic Oaks Second Subdivision will be cash in lieu of land (in the amount of$12,750).
