HomeMy WebLinkAboutResolution No. 178-04 RESOLUTION WHEREAS, Bigelow & Sons Enterprises identified wetland on the former ABC property at 41 st Street N.W., and West Circle Drive. The Type 2 wetland consists of a major drainageway that parallels 41St Street N.W., and is 5.9 acres in size. The applicant proposes to fill 25,367 square feet of wetland and provide a wetland replacement area for this project of 50,734 square feet. The replacement plan for this proposed fill will be on the same property. The applicant intends to create 53,270 square feet of new wetlands, a buffer area around the edge of the wetland, restoration of wetlands on site and a stormwater basin; and, WHEREAS, the Technical Evaluation Panel met and recommended approval of the application subject to the following conditions: 1. The applicant monitor the wetland area and submit annual reports until the wetland is established, and for up to five years as required by the rules. • 2. The wetland area be covered by a deed restriction that is in a form provided by BWSR and recorded by the applicant. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Replacement Plan presented by Biglow,& Sons Enterprises subject to the above conditions. The Mayor and the City Clerk are authorized and directed to approve this plan on behalf of the City.
