RESOLUTION
WHEREAS, St. Francis Catholic Church 'applied for an Incentive Development
Preliminary Plan (#04-02) to permit an addition to the existing school that would exceed the
permitted floor area ratio in the zoning district. The property is located along the north side of
Fourth Street S.E., and along the east side of 11th Avenue S.E., and has an address of 318 11tn
Avenue S.E.; and,
WHEREAS, R.C.O. § 62.630 sets forth the criteria for incentive developments; and,
WHEREAS, based upon Section 62.630, the Planning and Zoning Commission
recommended the following findings of fact:
Preliminary Development Plan Criteria:
a) Suitability of the Area: The proposed site is suitable as the location for an
Incentive Development. The proposed use should be compatible with the
existing land uses in the area.
• b) Site Design Criteria:
1) Capacity of Public Facilities: Public utilities exist on site. A Storm Water
Management fee shall be applicable for any increase in impervious
surface, resulting from this project.
2) Geologic Hazards: There are no known geological hazards within the site
area.
3) Natural Features: Not applicable.
4) Traffic Generation Impact: The proposed building expansion will not
generate any additional traffic.
5) Height Impacts: The proposed building expansion will be at the same
height as the existing structure.
6) Setbacks: The proposed addition complies with all required setbacks.
7) Internal Site Design: Not applicable.
8) Screening and Buffering: Not applicable.
• 9) Ordinance Requirements: The site currently does not meet 40% for

. landscaping requirements. There is an existing 64,592 square feet of
green space area equal to 28% of the site area. The proposed building
expansion will provide an additional 2% (3,528) of green space totaling
30%. The total parking stalls required prior to the building expansion total
154. The proposed building expansion will be providing an additional 3
parking spaces, totaling 157 parking spaces; and,
WHEREAS, the Commission, following its public hearing, recommended approval subject
to the following conditions:
1. A Storm Water Management fee shall apply for any increase in
impervious surface, resulting from this project.
2. Separate Grading Plan approval is required for this project, if grading
involves more than 50 cubic yards of material.
3. The condition of the existing concrete sidewalk and curb along the
frontages of this property will be reviewed by City Public Works staff, and
any needed panel repair and/or replacement of work of sidewalk or
curbing shall be done concurrent with the building expansion project.
WHEREAS, the Common Council held a public hearing on the Incentive Development
•Preliminary Plan #04-02 Permit request on April 19, 2004, and gave all interested persons the
opportunity to make presentations and give testimony concerning the application; and,
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that it adopt the Planning and Zoning Commission's findings of fact and that the
Incentive Development Conditional Use Permit requested by St. Francis Catholic Church is
granted subject to the above three conditions.
