HomeMy WebLinkAboutResolution No. 226-04 -y • RESOLUTION WHEREAS, Arcon Development identified wetlands on its Summit Pointe Fourth Subdivision property located east of 50th Avenue N.W., and south of 65t" Street N.W. The entire property is approximately 53 acres. The applicant needs to replace 0.43 acres (37,856 square feet) of Type 2 wetlands located in a drainageway that will be part of a larger outlot. The applicant has proposed filling of the wetland due to required street layout, and grading and trail crossings. The applicant proposes to replace the filled wetlands onsite in a drainageway adjacent to existing wetlands and off site in the Schmidt wetland bank located in Haverhill Township within the Zumbro River watershed. The 19,056 square feet of new wetland credits and 18,800 square feet of public value credits will be sufficient to meet the 2:1 replacement requirement; and, WHEREAS, the Technical Evaluation Panel met and recommended approval of the application subject to the following conditions: • 1. The applicant must'submit a Declaration of Restrictions and Covenants for the created wetlands on the development site. 2. The applicant must submit a copy of the wetland withdrawal form to the Planning Department. 3. The applicant must submit a certified check, letter of credit or bond in the amount of$12,600 for the wetland bank (until approval of the bank credits by BWSR). NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Replacement Plan presented by Arcon Development subject to the above conditions. • y • The Mayor and the City Clerk are authorized and directed to approve this plan on behalf of the City.
