WHEREAS, THE-G Rochester Joint Venture applied for a Type III, Phase II, Special
District Amendment Final Site Development Plan #04-01 to allow the construction of a Discount
Tire Company within the Northwest Plaza Development. The property is located within the 41st
Street Business Park and is zoned SD-1 (Arboretum Special District). The property is located
along the south side of 55th Street, east of the Merchants National Bank and west of the Affinity
Plus Credit Union and the future Snappy Stop restaurant; and,
WHEREAS, R.C.O. §§61.146, 62.708 provide the criteria for the review of this request;
and,
WHEREAS, the Planning Department staff recommended the following findings of fact for
this application:
Final Development Plan Criteria:
a) Public Facility Design: An approved grading/drainage plan is
required prior to construction and a Storm Water Management Fee
will apply for any areas of this property that do not drain to an
existing privately constructed detention facility approved to serve
• this development.
b) Geologic Hazard: There are no known geologic hazards on this
site.
c) Access Effect: It appears as though the proposed access
location is acceptable. The City and the Applicant have had
discussions regarding the Applicant's obligations regarding on-site
improvements that are planned to be incorporated in the City's
J6004, Traffic Signal Chateau Road & CSAH 22 (55th Street NW)
project. Execution of a Contributions Agreement is required to
address the Owner's obligations prior to final approval of this
Special District Amendment.
d) Pedestrian Circulation: There are no requirements for pedestrian
circulation associated with the development of this site.
e) Foundation and Site Plantings: A landscape plan for the site has
been prepared which identifies turf, shrubs and trees on-site.
fl Site Status: The applicant will need to work the City to obtain an
approved grading and drainage plan.

g) Screening and Bufferyards: The landscape plan includes turf,
trees and shrubs.
h) Final Building Design: The preliminary plan did not include
building elevations to use as a comparison.
i) Internal Circulation Areas: Plans for off-street parking and
loading areas and circulation aisles exceeds the ordinance
requirements in the number of parking spaces required.
j) Ordinance Requirements: The underlying zoning is the R-1
zoning district; however the property is located in the Arboretum
Special District, which is guided by the Arboretum Special District
language. The General Development Plan for the Arboretum
Special District identifies this property for commercial uses.
WHEREAS, on April 28, 2004, the Rochester Planning and Zoning Commission held a
public hearing on the proposed amendment, reviewed the application according to the
requirements of the above-named ordinances, adopted the Planning Department recommended
findings of fact, and recommended approval subject to the compliance with the following
conditions:
1. A Grading and Drainage Plan approval is required prior to development of
• this property and a Storm Water Management Fee shall apply for any
areas of this Property that do not drain to an existing privately constructed
detention facility approved to serve this development.
2. Prior to the issuance of building permits, the owner shall execute a
Contribution Agreement addressing the Owner's obligation regarding on-
site improvements that are planned to be incorporated in the City's J6004,
Traffic Signal Chateau Road & CSAH 22 (55th Street NW) project.
3. Any free standing signage for the property shall be limited to 20 to 25 feet
in height and a maximum signage area of 100 square feet.
WHEREAS, the Common Council held a public hearing on the Final Site Plan
Amendment request on May 17, 2004, and permitted all interested persons to be heard, and,

WHEREAS, following the hearing, the Council concluded that the request for Special
*District Amendment Final Site Development Plan #04-01 satisfied the provisions of R.C.O. §§
61.146 and 62.708 if the applicant satisfied the above three conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the Special District Amendment Final Site Development Plan requested by THF-
G Rochester Joint Venture (identified in the records of the Consolidated Planning Department as
Special District Amendment Final Site Development Plan No. 04-01) is granted subject to the
above three conditions.
