HomeMy WebLinkAboutResolution No. 387-04 • RESOLUTION WHEREAS, Gloria Dei Lutheran Church applied for an Incentive Development (#04-21) to permit the construction of a three-story addition to the east side of the existing building addin approximately 4,749 square feet of floor area to the site. The property is located north of 12 Street N.W., between 11th and 12th Avenue N.W.; and, WHEREAS, R.C.O. § 62.630 sets forth the criteria for incentive developments; and, WHEREAS, based upon Section 62.630, the Planning and Zoning Commission recommended the following findings of fact: Preliminary Development Plan Criteria: a) Suitability of the Area: The proposed site is suitable as the location for an Incentive Development. Other institutional uses in the immediate area include St. Pius church and school to the west, and Washington Elementary School to the east. b) Site Design Criteria: • 1) Capacity of Public Facilities: Utilities are already available to this project. 2) Geologic Hazards: Not applicable. 3) Natural Features: Not applicable. 4) Traffic Generation Impact: Additions to the Church are proposed to accommodate the needs of the existing membership. Increased trip generation is not anticipated. Closure of the existing north access to 11th Avenue NW, an arterial roadway, is a beneficial. 5) Height Impacts: Not applicable. 6) Setbacks: Further reduction of building setbacks along the east property line is being considered as a Variance request, as part of this application. 7) Internal Site Design: Not applicable. 8) Screening and Buffering: The project includes landscaping • materials and foundation plantings. The north parking lot will be • provided with new landscaping along the north and west perimeters of the lot, adjacent to the residential properties. 9) Ordinance Requirements: The site provides the minimum number of off street parking stalls. Additional landscaping is proposed to balance the reduction of landscape area on-site and the applicant is requesting a Variance to reduce landscape area. The development performed a Landscape Area Reduction formula that would support a reduction in landscape area by 6.73%, and they propose to reduce the area by 4.3%; and, WHEREAS, the Commission, following its public hearing, recommended approval subject to the following conditions: 1. The applicant must construct sidewalk, curb and gutter, and must restore the boulevard area adjacent to the property along 12th Avenue N.W., and along the missing segment of 12th Street N.W., concurrent with this project. Alternatively, the applicant may execute a pedestrian facilities agreement prior to issuance of any development permits (i.e., zoning certificate) for this project specifying that said improvements will be completed within two years of execution of the agreement. 2. Any needed panel repair and/or replacement work of sidewalk or curbing shall be done concurrent with the building expansion project. 3. Separate Grading Plan approval is required for this project is grading will involve more than 50 cubic yards of material. 4. A Storm Water Management fee will be applicable to any new additional areas of impervious surface associated with the proposed building addition. 5. The property consists of multiple parcels. These parcels must be combined onto one deed, and joined through County Property Records prior to issuance of development permits. WHEREAS, the Common Council held a public hearing on the Incentive Development Preliminary Plan #04-21 Permit request on August 2, 2004, and gave all interested persons the opportunity to make presentations and give testimony concerning the application; and, NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that it adopt the Planning and Zoning Commission's findings of fact and that the .Incentive Development requested by Gloria Dei Lutheran Church is granted subject to the above 2 ive conditions.
