HomeMy WebLinkAboutResolution No. 414-04 \ � ) -4/4 RESOLUTION WHEREAS, Mayo Foundation applied for an amendment to Incentive Development Conditional Use Permit #98-29 to add four levels plus a penthouse to the Stabile building for the Minnesota Partnership for Biotechnology and Medical Genomics. The property is located south of Third Street S.W., and east of Second Avenue S.W.; and, WHEREAS, R.C.O. § 62.630 sets forth the criteria for incentive developments; and, WHEREAS, based upon Section 62.630, the Planning and Zoning Commission recommended the application be approved based upon the original findings of fact; and, WHEREAS, the Commission, following its public hearing, recommended approval subject to the following conditions: 1. The applicant shall submit data to the Rochester Public Works Department regarding additional wastewater that will be generated as a result of this vertical building addition. • 2. The applicant shall submit calculations to the Rochester Public Works Department to address impacts to the storm sewer system resulting from the increased vertical surface proposed for this project; and, WHEREAS, the Common Council held a public hearing on the request to amend Incentive Development Conditional Use Permit #98-29 on August 16, 2004, and gave all interested persons the opportunity to make presentations and give testimony concerning the application; and, NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that it adopt the Planning and Zoning Commission's findings of fact and that the amendment to Incentive Development Conditional Use Permit #98-29 requested by Mayo Foundation is granted subject to the above two conditions. • • PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS /k7-,-/ DAY OF T 2004.
