RESOLUTION
WHEREAS, the Project has been determined to be eligible for the expenditure of federal
aid funds and is programmed in the approved federally approved STIP for fiscal year 2004;
WHEREAS, the Project is identified in MnDot records as State Project (SP) 159-080-12,
and in Federal Highway Administration (FHWA) records as Minnesota Project Number STP
5504 (103), and in CitX of Rochester Project M074, J-9708 and titled "Overland Drive NW from
18th Avenue NW to 65 Street NW".
WHEREAS, FHWA has amended western Project limit from station 737 + 81750 to station
732 + 50.00.
WHEREAS, District Area 6 Transportation Partnership (ATP) approved the use of
$1,900,000.00 in federal funding for the Project.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that, pursuant to Minnesota Statutes Section 161.36, the City appoint the
Commissioner of Transportation as agent of the City of Rochester to accept as its agent, federal
aid funds which may be made available for eligible transportation-related projects.
• BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and
directed for and on behalf of the City to execute and enter into an agreement with the
Commissioner of Transportation prescribing the terms and conditions of said federal aid
participation as set forth and contained in Minnesota Department of Transportation Agency
Agreement No. 86842, a copy of which said agreement was before the Common Council and
which is made a part hereof by reference.
The Mayor and the City Clerk are authorized and directed to execute this agreement on
behalf of the City.
