RESOLUTION REGARDING
REPLACEMENT OF
KINGS RUN TRUNKLINE SANITARY SEWER, J7708
AND
REPLACEMENT OF LIFT STATION #4, J4366.
WHEREAS, the City of Rochester and Olmsted County have established an Urban
Service Area for the purposes of planning the orderly, efficient and cost-effective development
of the undeveloped lands surrounding the City; and,
WHEREAS, the Urban Service Area defines the proposed limits of future city growth
and thereby establishes definitive areas for which public infrastructure such as roads, water,
sewer and storm water must be planned, designed and constructed to serve the ultimate build
out of those areas; and,
WHEREAS, in 1973, the Public Works Department, with the use of population projections
and land use data provided by the Planning Department, completed a "Sanitary Sewer and
Water Study" with a primary objective of "the development of a long range plan for the
construction of an adequate sewerage system to serve the need of Rochester's metropolitan
�rea;" and,
WHEREAS, the "Sanitary Sewer and Water Study" consisted of two separate phases of
engineering investigation; "one of a systematic evaluation of the existing trunk and sub-trunk
sewers to determine its adequacy to convey the expected sewerage flows from an enlarged
service area, and another of the development of a long range plan for the orderly and
economical provision of service for the suburban fringe area;" and,
WHEREAS, the "Sanitary Sewer and Water Study" states that "the establishment of the
boundaries and areas of sewer districts is essential to estimating cumulative flows in the various
trunk sewers ... for the determination of the adequacy of the in place sub-trunks and trunk line
sewers to handle existing and future sewage flows;" and,
WHEREAS, the 1973 "Sanitary Sewer and Water Study" recommended that the design
and location of a new permanent Lift Station 4 should accommodate sewer flows projected to
occur by the Year 2020 from the developing area of Northwest Rochester known as the
Northwest Property Owners Association (NWPOA) or otherwise referenced as Sewer Service
Area 28A-K (SSA 28A-K), and the portions of the Hadley Valley Sewer Service Area (SSA 29)
east of the Zumbro River and north of 37th street N.E., not served with public sewer service.
Both of these areas ultimately became part of the Urban Service Area; and,
WHEREAS, on November 1, 1976, the City Council received a Preliminary Progress
Report from the Public Works Department that set forth Project 7301, Stage 1 of Northwest Area

Trunk Line Sanitary Sewer, Pumping Station, Force Main and Outfall Sewer; and,
WHEREAS, at a December 6, 1976, public hearing, the City Council set forth their intent
to provide adequate trunk sewer facilities to serve the entire Stage 1 area of approximately 1,000
acres by providing a temporary sewer lift station, outfall sewer and trunk sewers at a cost of
$817,510 and further assessing that cost to benefiting property at a rate of $817.51 per
developable acre; and,
WHEREAS, the City had planned and, in 1977, constructed a temporary Sewer Lift
Station 4 (LS 4) to provide sanitary sewer service to approximately 1,000 developable acres in
Stage 1 of the developing area of Northwest Rochester known as NWPOA; and,
WHEREAS, on May 4, 1992, the City Council set forth Project 7301-91, Extension of
N.W. Trunkline Sewer, N.W. Plaza to Douglas Trail, Watermain and Sanitary Sewer to 660 Feet
West of 50th Avenue N.W., to serve an area of approximately 1,284 undeveloped acres in Stage
2; and,
WHEREAS, at a May 16, 1994, public hearing, the City Council set forth its intent to
provide adequate water and sewer facilities, and to have newly developing areas of
approximately 775 developable acres in the Stage 2 area pay for the additional infrastructure
required to provide adequate water and sewer facilities, including the construction of Stage 2
improvements to the temporary Lift Station 4, all at a cost of$738,121.36, and further assessing
the cost of the Stage 2 lift station and trunk sewer improvements against benefiting property at a
leate of$392.54 per developable acre and $35.13 per assessable foot; and,
WHEREAS, the Stage 1 and 2 temporary Lift Station 4 improvements and the various
trunk sewer improvements were designed, financed by benefiting property owners, and
constructed by the City to serve the entire SSA 28A-K, consisting of approximately 2,442
developable acres consistent with the "Sanitary Sewer and Water Study" dated August 1,
1973, and City Council approvals on November 1, 1976, December 6, 1976, May 4, 1994, and
May 16, 1994; and,
WHEREAS, in January, 1996, the City completed, with the assistance of Black and
Veatch Consulting Engineers, an update to its Wastewater Collection System Master Plan that
provided a cursory review of the capacity of the existing trunk sewers, evaluated the impact on
trunk sewer capacity and system adequacy for projected population growth and contributing
sewer flows in the community between 1995 and 2020, and made corresponding long term
capital funding recommendations; and,
WHEREAS, the analysis performed as a part of the 1996 Wastewater Collection
System Master Plan expanded the Kings Run Sewer Service Area by 613 acres from its prior
western Stage 2 limit of 50th Avenue N.W., to a new western limit of 60th Avenue N.W.; and,
WHEREAS, the 1996 Wastewater Collection System Master Plan concluded that
certain portions of the trunk sewer system serving areas, previously described as the NWPOA,
ore recently named the Kings Run Sewer Service Area and now defined with a western

boundary of 60th Avenue N.W., would not have adequate future sewer capacity based on an
�ssumed moderate growth rate between 1995 and 2015; and,
WHEREAS, the 1996 Wastewater Collection System Master Plan estimated the cost at
$3,890,000 to replace certain portions of the existing trunk sewer system to serve the revised
Kings Run Sewer Service Area to its new western edge at 60th Avenue N.W., at $3,890,600;
and,
WHEREAS, the 1996 Wastewater Collection System Master Plan recommended that
the new Lift Station 4 should be designed, located and constructed in the future to serve the
existing and projected sewer flows between 1995 and 2015 from both the existing Kings Run
Sewer Service Area and the portions of the Hadley Valley Sewer Service Area without public
sewer service; and,
WHEREAS, on June 17, 2002, the City Council received a petition from Western Walls,
Inc., and Bigelow Enterprises, Inc, requesting that the city initiate a feasibility study for the
"Extension of Sanitary Sewer and Watermain to the Kirkland-Clowes Property in Cascade
Township and the Schleusner Property in Kalmar Township"; and,
WHEREAS, the City Council referred said petition to the Public Works Department and
shortly thereafter the city retained Black and Veatch Consulting Engineers (B&V) to conduct
an update to the 1996 Wastewater Collection System Master Plan that updated the available
sewer capacity and limitations in the Kings Run Sewer Service Area which is a sewer service
�rea tributary to Lift Station 4; and,
WHEREAS, the Public Works Department directed B&V to prepare Kings Run Analysis,
dated November 14, 2002, which concluded that certain segments of the existing trunk sewer
lack sufficient capacity to serve the portion of the Kings Run Sewer Service Area lying east of
60th Avenue N.W., and the cost to construct a parallel relief sewer line to serve this area would
be approximately $2,608,380; and,
WHEREAS, the Public Works Department also directed B&V to prepare a
Supplemental Analysis to the Kings Run Analysis to determine the required trunk sewer
capacities to serve an additional 2,300 acres lying west of 60th Avenue N.W.; and,
WHEREAS, the B&V-prepared Supplemental Analysis, dated January 15, 2003,
concluded that all segments of the existing trunk sewer between Lift Station 4 and the Douglas
Trail lacked sufficient capacity to serve the additional 2,300 acres lying west of 60th Avenue
N.W., and the cost to construct a parallel relief sewer line to serve this area would be
approximately $3,471,374; and,
WHEREAS, on October 27, 2003, the City Council received a report on the various Lift
Station 4 replacement / relocation alternatives, as prepared by the team of HR Green and
CH2MHill Consulting Engineers, which relied upon and incorporated the results / findings of
B&V Kings Run Analysis, dated November 14, 2002 and the Supplemental Analysis, dated
January 15, 2003; and,

• WHEREAS, at the conclusion of the October 27, 2003 Committee of the Whole Meeting,
the City Council directed staff to move forward with further preliminary engineering associated
with the design of a deep gravity flow sewer tunnel from the Water Reclamation Plant to the
approximate location of the existing Lift Station 4 at a preliminary estimated cost of
$18,000,000 in lieu of the construction of a sewer lift station to collectively serve all of the
Kings Run, Hadley Valley and Northwest Territories Sewer Service Areas (which includes all of
the 2,300 acres lying west of 60th Avenue N.W.); and,
WHEREAS, the City Council has further expressed their intention to move forward with
the replacement of Lift Station 4 by authorizing the necessary funding for Project No. M4-44,
J4366 "Replacement of Lift Station #4 With Gravity Flow Trunkline Sanitary Sewer (Tunnel
Option)" in the 2004-2009 Capital Improvement Program; and,
WHEREAS, the Public Works Department has prepared a feasibility report entitled "Lift
Station No. 4 Replacement, dated October 18, 2004, which formally sets forth the project
costs and sources of project revenues based on the calculated Sewer Availability Charge
(SAC) of $1,461 per developable acre for Project No. M4-44, J4366 "Replacement of Lift
Station #4 With Gravity Flow Trunkline Sanitary Sewer (Tunnel Option)"; and,
WHEREAS, the City Council has further expressed their intention to move forward with
the replacement of the Kings Run Trunk sewer by authorizing the funding for Project No. M2-
38, J7708 "Replacement of Kings Run Trunkline Sanitary Sewer" in the 2004-2009 Capital
Omprovement Program; and,
WHEREAS, the Public Works Department has prepared a feasibility report entitled
"Replacement of Kings Run Trunkline Sanitary Sewer, dated October 18, 2004, which formally
sets forth the project costs and sources of project revenues based on the calculated Sewer
Availability Charges (SAC) of $2,071 per developable acre for the undeveloped areas within
the Kings Run Sewer Service Area and a Sewer Availability Charges (SAC) of $564 per
developable acre for the undeveloped areas within the Kings Run West Sewer Service Area
both within Project No. M2-38, J7708 "Replacement of Kings Run Trunkline Sanitary Sewer";
and
WHEREAS, both of the feasibility reports came before the Council for action at its
October 18, 2004, meeting.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City take the following action:
1. Accept the feasibility report for Project No. M4-44, J4366, "Replacement of Lift
Station #4 With Gravity Flow Trunkline Sanitary Sewer (Tunnel Option)."
2. Accept the feasibility report for Project M2-38, J7708, "Replacement of Kings Run
Trunkline Sanitary Sewer."

3. Set forth a project revenue source by establishing the Sewer Availability Charge of
• $1,461 per developable acre for Project No. M4-44, J4366 "Replacement of Lift
Station #4 With Gravity Flow Trunkline Sanitary Sewer (Tunnel Option)";
4. Set forth a project revenue source by establishing the Sewer Availability Charge of
$2,071 per developable acre for the undeveloped areas within the Kings Run
Sewer Service Area and a Sewer Availability Charges (SAC) of $564 per
developable acre for the undeveloped areas within the Kings Run West Sewer
Service Area both within Project No. M2-38, J7708 "Replacement of Kings Run
Trunkline Sanitary Sewer."
