WHEREAS, the City is required by its charter and by state law to award to the lowest
responsive and responsible bidder those public improvement contracts that call for the
construction, alteration, repair, or maintenance work of real or personal property; and
WHEREAS, the City desires to establish a procedure to review the qualifications and
experience of"responsible" bidders that does not impede free and open bidding by all interested
parties and that gives all bidders.an equal opportunity without granting an advantage to one or
placing others at a disadvantage.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester hereby establishes a Responsible Bidder Evaluation Policy.
Policy Establishing Responsible Bidder Evaluation
A. A "responsible bidder" is a bidder qualified"to and capable of performing the work
in the manner and within the time limits required by the plans and specifications for the proposed
project. Responsibility is determined by assessing the skill, resources, experience and
successful performance of similar contracts, and all other matters bearing upon the likelihood
that the contract will be successfully completed.
B. The City may require that all bidders for a particular project provide evidence of
Wesponsibility in the bidding documents. The bidding documents may require the bidders to
present the following information:
1) Identify all similar public projects in which you were the contractor. If you have had
more than five such contracts, list only the last five contracts, and as to each
contract identified provide the following information:
a) Project description including contract amount ,
b) Date
c) Contact person for City/County/State/Owner
d) Were change orders in excess of "5% requested? If yes, explain the
circumstances
e) Were liquidated damages assessed? If yes, explain the circumstances
f) Was the project completed on schedule? If no, explain the circumstances
2) Describe all construction arbitration claims and any construction or project litigation
in which you have been a party in the last five years and include the following
information:
a) Project description
b) Date
c) Contact person for City/County/State/Owner
• d) The issue and outcome

3) Identify all public projects you have had with the City of Rochester in the last five
years.
4) In the last five years was a bonding company ever refused to issue you a
performance bond? If yes, explain the circumstances.
5) In the last five years have any claims been filed against a performance or payment
bond that you have provided a public entity? If yes, explain the circumstances.
6) In the last five years, has your firm or any of its owners or employees been fined
by a federal or state agency for a contract or workplace matter (such as wage or
hour or safety violations), or debarred under Part 29, Title 49 CFR or any other law
from submitting bids on public projects? If yes, explain the circumstances.
7) In the last five years, has your firm or any of its owners or employees been
charged or convicted of a crime involving the awarding, bidding or performance of
a government contract? If yes, provide full details.
C. City staff may establish a point system to be used in scoring the criteria
established above. The bidding documents shall identify if a scoring system is to be used and
shall define the scores to be applied based on bidder's information submitted. City staff may
_confirm the accuracy of the information provided by contacting the owner of the project
referenced in the bid submittals.
D. In the event City staff believes it appropriate for the Common Council to consider
the rejection of the lowest responsive bidder as being non-responsible, a hearing shall be
scheduled before the Common Council, upon reasonable notice to the bidder, at which time the '
bidder may appear and present evidence as to why the bidder should not be determined to be
non-responsible.
