• RESOLUTION
WHEREAS, Rochester Development, Inc., applied for an amendment to Incentive
Development #00-35, known as Broadway Plaza. The Applicant is proposing building
identification signage and is proposing general signage for future tenants of the commercial
space (specific names would be determined later). The property is located at 15 .1st Street SE,
north of 1st Street SW, east of Broadway; and,
WHEREAS, R.C.O. § 62.630 sets forth the criteria for incentive developments; and,
WHEREAS, based upon Section 62.630, the Planning and Zoning Commission
recommended the following findings of fact:
Final Development Plan Criteria:
a) Public Facility Design: Any signs projecting over public right-of-way will require
approval of a Revocable Permit. This would need to be coordinated with the
Rochester Public Works Department.
b) Geologic Hazard: Not Applicable.
c) Access Effect: Not Applicable.
• d) Pedestrian Circulation: Not Applicable.
e) Foundation and Site Plantings: Not Applicable.
f) Site Status: Not Applicable.
g) Screening and Bufferyards: Not Applicable.
h) Final Building Design: The "Oakwood Broadway Plaza" sign, materials, size and
location identified on the proposed plan are appropriate for the building. The
materials area similar to the banding above the doors, and the materials located
between the first and second story.
Building signage for future tenants (Signs "A", "B", and "C"), as proposed, do not
compliment the quality of materials and construction of the building, or the area.
The tenant cabinet is unnecessary and conflicts with an existing exterior light
mounted on the wall in the location of the proposed sign. This cabinet, and the
style of signs proposed for "A", "B", and "C", are not consistent with architectural
elements included in the approved Final Development Plans for the building and
would compromise the building if approved. There are very few, examples in
downtown Rochester of buildings that have exterior mounted tenant identification
signs. This type of sign is not necessary where an opportunity exists to display
other individual signs to the public. Alternate signage should be considered and
• proposed for tenant identification that compliments the building and eliminates
the use of a sign that lists tenants of the building.
i) Internal Circulation Areas: Not Applicable.
j) Ordinance Requirements: Signs would need to comply with the standards
applying to conventional development in the CDC-CBD District; and,
WHEREAS, the Commission, following its public hearing, recommended approval of the
"Oakwood Broadway Plaza" signs and denial of the tenant signs; and;
WHEREAS, the Common Council held a public hearing on the amendment to the
Incentive Development Preliminary Plan #00-35 on February 23, 2005, and permitted all
interested persons to be heard.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that it adopt the Planning and Zoning Commission's findings of fact and that the
amendment to the Incentive Development requested by Rochester Development, Inc., is granted
with respect to the "Oakwood Broadway Plaza" signs and denied as to the tenant signs.
