RESOLUTION
WHEREAS, the rare occurrence of calcareous fens and the unique character of their
plant and animal communities has led to state law that classifies them as an Outstanding
Resource Value Water that must receive special protection under the Wetland Conservation
Act and the City's MS4 storm water permit; and
WHEREAS, current local knowledge regarding the importance and location of protected
wetlands known as calcareous fens can reduce the potential for effective protection, contribute
to costly delays in the development process, lead to ineffective implementation of Fen
Management Plans; and,
WHEREAS, effective tools and processes are needed to communicate the roles
various parties have in protecting calcareous fens to prevent unwanted negative impacts to
members of the development community, homeowners, natural resource professionals, and
the protected natural resources; and,
WHEREAS, the Environmental Protection Agency is currently accepting Smart Growth
Implementation Assistance Applications without a monetary commitment for technical
assistance to develop public participatory processes that support smart growth and natural
•resource protection; and,
WHEREAS, the objectives of-the project are to create the tools and processes to
effectively communicate fen protection needs and roles to all entities that have the potential to
impact calcareous fens as a result of urban development; and
........WHEREAS, a cross-section of knowledgeable partners (including the U.S. Geological
Survey, the Department of Natural Resources, the City of Rochester, and representatives of
the developer, contractor, consultant, realtor, and homeowner groups) have voluntarily agreed
to assist in this project; and
WHEREAS, documentation of elected official support must be included in the
application.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the City does support the submittal of a Smart Growth Implementation
Assistance Application to the Environmental Protection Agency by May 19, 2005, to meet the
objectives described above.
