WHEREAS, APD Engineering applied for a Final Site Plan Amendment #05-01 to allow
the construction of a customer loading canopy to the front of the existing Sam's Club and a
drive-thru pharmacy on the rear of the building. The property is located,south of 55th Street
N.W., west of Highway 52 and within the Northwest Plaza and the Arboretum Special District;
and,
WHEREAS, R.C.O. §§61.146, 62.708 provide the criteria for the review of this request;
and,
WHEREAS, the Planning Department staff recommended the following findings of fact for
this application:
Final Development Plan Criteria:
a) Public Facility Design: An approved grading/drainage plan is
required prior to construction.
b) Geologic Hazard: There are no known geologic hazards on this
site.
• c) Access Effect: Access to this property is from within an internal
private road system serving the Northwest Plaza development.
d) Pedestrian Circulation: Modifications to the site plan, along the
front of the building, are recommended to minimize conflict
between the vehicle and pedestrian movements.
e) Foundation and Site Plantings: This petition does not include
modifications to site plantings.
f) Site Status: If construction of public infrastructure is required for
this project, approved construction plans and execution of an
owner contract will be required.
g) Screening and Bufferyards: This amendment does not include
modifications that require changes to bufferyards or screening.
h) Final Building Design: The final building design is consistent with
the principles identified in preliminary development plan relative to
height impact, setbacks and internal site design.
i) Internal Circulation Areas: Modifications to the site plan, along
• the front of the building, are recommended to minimize conflict
between the vehicle and pedestrian movements.
• j) Ordinance Requirements: This proposal appears consistent with
applicable regulations.
WHEREAS, on April 13, 2005, the Rochester Planning and Zoning Commission held a
public hearing on the proposed amendment, reviewed the application according to the
requirements of the above-named ordinances, adopted the Planning Department recommended
findings of fact, and recommended approval subject to the compliance with the following
conditions:
1. A grading plan must be submitted for review and approval by the Rochester
Public Works Department prior to zoning certificate approval.
2. A revised site plan shall be filed with the Planning Department identifying
additional bollards between the merchandise loading lane and pedestrian
walk adjacent to the front of the building, and modifying the crosswalks or
the merchandise loading lane to eliminate the overlap area and conflict
between the two.
WHEREAS, the Common Council held a public hearing on the Final Site Plan
Amendment request on May 2, 2005, and permitted all interested persons to be heard, and,
WHEREAS, at the May 2"d public hearing, the Council was informed that the applicant
•submitted a revised site plan that addressed condition #2. As such, the Planning Department
staff recommended the deletion of condition #2; and,
WHEREAS, following the hearing, the Council concluded that the request for Final Site
Plan Amendment#05-01 satisfied the provisions of R.C.O. §§ 61.146 and 62.708 if the applicant
satisfied condition #1.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the Final Site Plan Amendment requested by APD Engineering (identified in the
records of the Consolidated Planning Department as Final Site Plan Amendment #05-01) is
granted subject to the above condition #1.
