HomeMy WebLinkAboutResolution No. 186-05 1 / , � 1 .--.. .5. - `'= -t:,«.sue.?-..m.:c.ux+,_.-.-�.ti..._�x .....ha,vkweY•.....v.: +�srsiwSSSa�i.- ^+.oGf.]w.cd+smr.i....ti.(:w,.xa a...9�...,�to s RESOLUTION WHEREAS, Chapter 428A of the Minnesota Statutes sets for the process for the establishment of a special service district; and, WHEREAS, the City of Rochester Common Council has initiated the process whereby a special service district will be established in downtown Rochester; and, WHEREAS, on April 4, 2005, the day of the public hearing on the ordinance establishing the special district, Tim Hickey of Chuck's Tire and Auto, 102 North Broadway, Rochester, MN, indicated his objection to his property's inclusion within the special district for the reason that neither his property nor its use would benefit by the proposed special service; and, WHEREAS, Minn. Stat. Section 428A.02, subd. 4 states that, upon receipt of such an objection, the city's governing body must make a determination on the objection within 30 days of its filing; and, WHEREAS, the Common Council of the City of Rochester considered this matter at its •regularly-scheduled meeting of May 2, 2005; and, WHEREAS, after considering the matter and hearing the evidence presented, the Council concluded the following: 1. The primary objective of the special service district is to market and promote the City's downtown area in order to improve its economic vitality and increase property values. 2. Chuck's Tire and Auto is a retail tire and auto repair facility that will benefit from the services provided through the charges. 3. Specifically, the business will benefit from the retention of existing downtown employees, businesses and residents, and from the attraction of new ones. 4. In addition, the value of the property will be enhanced by the efforts undertaken with district funds. NOW, THEREFORE BE IT RESOLVED, that the Common Council of the City of Rochester hereby determines that Tim Hickey, as owner of the property known as Chuck's Tire and Auto, and located at 102 North Broadway, Rochester, MN, will receive a benefit from •the proposed special district for the reasons stated herein. r i. 777 BE IT FURTHER RESOLVED that the Council does hereby deny the landowner's • objection.
