HomeMy WebLinkAboutResolution No. 188-05 - �,,,._ A �-_E-+.., � d }'.^i; z j?, .t :'e�';'¢�..,,'rz ;, ..., _..�, t.� ���•-y, 7= .e ; a. ,c ., t' -?��i�7�� -., ���..7� �F y,s 2�t t ff AV RESOLUTION WHEREAS, in 1996, the South Zumbro Watershed Joint Powers, the City of Rochester, and Olmsted County agreed to transfer the land acquired for flood control purposes, known as Reservoir WR-6A, to the City of Rochester; and WHEREAS, the primary purpose for Reservoir WR-6A is to provide flood protection for . areas downstream of the reservoir; and WHEREAS, Reservoir WR-6A is also used for multiple purposes that do not conflict with its flood protection function; and WHEREAS, those multiple purposes include but are not limited to: fishing, wildlife habitat, hiking, nesting habitat for birds, and the use of non-motorized watercraft; and WHEREAS, the lands at Reservoir WR-6A are within or adjacent to the City limits of the City of Rochester, and WHEREAS, the Rochester Park Board manages several other areas of City owned lands as natural resource parks involving multiple uses; and, WHEREAS, Section 14.02 of the Rochester Home Rule Charter states that the Rochester Park Board has management and control of all the parks and parkways of the city. NOW, THEREFORE, BE IT RESOLVED that the Rochester Common Council hereby declares the WR-6A Reservoir as a park of the City of Rochester and transfers management authority for recreational and natural resource uses at the WR-6A Reservoir to the Rochester Park Board, subject to the following provisions: 1. The primary function of the WR-6A Reservoir is for flood protection for downstream areas and that function will take priority over all other uses if such uses conflict. 2. The Park Board shall consult with the City Administration, City Public Works Department and the Natural Resource Conservation Service concerning flood control impacts relating to proposed uses. 3. The Park Board shall manage the lands at the WR-6A Reservoir as a natural resource park similar to Quarry Hill and Essex Park for passive recreation and multiple purposes such as, but not limited to, the continued use of the reservoir for fishing, wildlife habitat, nesting for birds, trails, and the use of non-motorized watercraft. • 4. This transfer of management authority has no effect upon any decision made by the Common Council relating to the Scenic Oaks Lakeview Subdivision and the subsequent land uses and platting decisions for that subdivision.
