HomeMy WebLinkAboutResolution No. 222-05 i RESOLUTION WHEREAS, Olmsted Land Group, LLC, has proposed the filling of 0.35 acres of Type 2 wetland on property located east of West Circle Drive, south of Highway 14 and north of Ninth Street N.W. The wetland is a part of a larger wetland adjacent to the South Run of the North Fork of Cascade Creek and is located in the northeast corner and along the eastern property line of the property. The wetland is proposed to be used for a stormwater pond and fill in the wetland outside of the Floodway. The applicant proposes replacement with a wetland bank located in Olmsted County within the Zumbro River watershed; and, WHEREAS, the Technical Evaluation Panel (TEP) reviewed the alternatives and found that they meet the minimum standards for sequencing. The TEP also agreed that avoidance of the wetlands is not feasible due to the configuration and location of the wetland, previous public utility and road improvements prior to the wetland rules adoption, existing topography and limited placement options for the stormwater pond; and, • WHEREAS, this matter came before the City of Rochester Common Council on June 6, 2005, for a final decision on the replacement plan. The Council gave all interested parties an opportunity to be heard on this matter and considered all information presented to it including that information found within the Council Agenda packet (a copy of which is attached hereto and identified as Exhibit A). NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by the Olmsted Land Group, LLC, for the property located in the Radichel First Replat. BE IT FURTHER RESOLVED that this approval is subject to the condition that the applicant provide a copy of the final approval of the purchase of credits by the Board of Water and Soil Resources.
