WHEREAS, Volunteers of America applied for an Incentive Development Final Plan (#03-
60) to allow the construction of a four-story congregate housing building with a total of 200 units.
The location of the building is just east and south of the detention pond on the property. The
property is located along the north side of 55th Street N.W., and along the west side of 18tn
Avenue N.W. ; and,
WHEREAS, R.C.O. § 62.630 provides the criteria for incentive developments against
which this application must be analyzed; and,
WHEREAS, on May 11, 2005, the Rochester Planning and Zoning Commission held a
public hearing on this final plan, reviewed the application according to the criteria in R.C.O. §
62.630(2), and suggested the following findings of fact:
Final Development Plan Criteria:
a) Public Facility Design: Public utilities have already been installed on the
property however due to this site design some utility lines will need to be
relocated. In addition to the relocation of some utilities the utility
• easements will need to be vacated. The public utilities are adequate to
accommodate the proposed development.
b) Geologic Hazard: There are no known geologic hazards related to this
project.
c) Access Effect: The proposed use will not cause the capacity of the
adjacent roadway to be exceeded. 55th Street NW is classified as an
"Expressway" roadway and 18th Avenue NW is classified as an "Arterial'
on the Thoroughfare Plan. The applicant shall obtain an Olmsted County
Highway Access Permit for the proposed access on 18th Avenue NW (CR
112) prior to building permits being issued.
d) Pedestrian Circulation: The plan includes elements to assure that
pedestrians can move safely both within the site and across the site
between properties and activities within the development. Connection to
the public .trail system running around the regional storm water
management ponds on the property is provided for.
e) Foundation and Site Plantings: A detailed landscape plan for the site has
been prepared which indicates the plantings for the development as well
as a fence along the west side of the private roadway. A large portion of
the VOA development has yet to be developed. Future landscaping in the
• development will likely be consistent with the landscaping for this building.

• Site Status: The entire property is under the ownership of VOA and there

is an executed Development Agreement which addresses the owners'
responsibility regarding ownership and maintenance of the storm water
ponds. Construction plans for utilities must be prepared by an engineer
and be submitted to and approved by the City prior to
relocation/construction. An Owner Contract will be 'required for
construction of any new public infrastructure required.
g) Screening and Bufferyards: According to the landscaping plan provided
there will be an abundant amount of landscaping on the property. There
will be more landscaping then what currently exists on the property.
h) Final Building Design: The final building design is consistent with the
principles identified in preliminary development plan relative to Height
Impact, Setbacks, and Internal Site Design. The north wing of the building
is now planned as a future addition because of the current market
demand and would not be constructed in the initial construction.
i) Internal Circulation Areas: Plans for off-street parking and loading areas
meet the ordinance requirements in terms of design.
• j) Ordinance Requirements: The proposed development is consistent with
the requirements of the underlying zoning district for similar uses and
provides for emergency access; and,
WHEREAS, the Rochester Planning and Zoning Commission recommended approval
subject to the following conditions:
1. A separate grading plan approval is required for this project prior to the
issuance of building permits.
2. The property shall be replatted and the Mylar's recorded prior to the
issuance of any building permits for the property.
3. The applicant agrees that no deviation to the appearance of the building,
design, exterior fagade or landscaping will occur from the plans approved
by the City Council. Phase II can be constructed with no further public
review only it is consistent with these plans.
4. The cost of any needed City utility modifications and easement vacations
will be the responsibility of the Owner/Developer. Any such work must be
performed under a City/Owner Contract and will need to conform to the
standard City of Rochester requirements.
• 5. Since the stormwater detention facility is intended to be public, the Owner

is obligated to mitigate any storage lost on-site or at the City's discretion
provide compensation for the lost storage caused by the filling to
accommodate the development. Specific obligations will be addressed
via an amended Development Agreement.
6. All private roadways less than 26 feet in width shall be posted "No
Parking" along both sides of the roadway.
7. A minimum of 3 hydrants shall be available for service and spaced around
the perimeter of the building along the fire department access roadways.
Any such work must be performed under a City/Owner Contract.
8. The Owner shall obtain an Olmsted County Highway Access Permit for
the.proposed access on 18th Avenue NW (CR 112).
WHEREAS, the Common Council held a public hearing on the incentive development
preliminary plan request on June 6, 2005, and gave all interested persons an opportunity to give
testimony and make presentations; and,
WHEREAS, the Applicant's representative appeared at the public hearing and testified
that the Applicant agreed with all of the above conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
* Rochester that it adopt the Planning and Zoning Department's findings of fact and that the
incentive development final plan #03-60 requested by Volunteers of America is granted, subject
to the above eight conditions.
