RESOLUTION
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, Mark Leitzen initiated an amendment to the Rochester Urban Service Area
Land Use Plan to change the land use plan designation for property located south of the
Southport development, west of County Road 1 and north of Highway 52. The applicant seeks
• to change the property's land use plan designation from the "Low Density Residential"
designation to the "Commercial" designation; and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended the denial of the proposed amendment to the City's
"LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on June 6, 2005, on the matter of the proposed
amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Low Density Residential" designation to the "Commercial" designation:
That part of the Northeast Quarter of Section 24, Township 106 North, Range 14
West, Olmsted County, Minnesota, described as follows:
• Commencing at the northeast corner of said Northeast Quarter; thence South 89
degrees 50 minutes 44 seconds West, assumed bearing, along the north line of
said Northeast Quarter, 1054.84 feet; thence South 00 degrees 09 minutes 16
minutes East, 499.57 feet for the point of beginning; thence North 80 degrees 53
minutes 50 seconds East, 700.24 feet to the westerly right of way of County
• State Aid Highway 1 as defined on State Highway Right of Way Plat No. 55-3
(the next five courses are along said westerly right of way line); thence South 09
degrees 06 minutes 10 seconds East, 142.98 feet; thence South 23 degrees 08
minutes 23 seconds East, 41.23 feet; thence South 09 degrees 06 minutes 10
seconds East, 65.00 feet; thence South 18 degrees 39 minutes 22 seconds
West, 107.35 feet; thence South 09 degrees 06 minutes 10 minutes East,
313.90 feet to the northerly right of way of Trunk Highway No. 52 as defined on
State Highway Right of Way Plat No. 55-2; thence South 82 degrees 20 minutes
14 seconds West, along said right of way, 760.90 feet; thence North 00 degrees
09 minutes 16 seconds West, 645.61 feet to the point of beginning.
Said Parcel contains 10.87 acres, more or less.
BE IT FURTHER RESOLVED the "LAND USE PLAN" as adopted on March 24, 1980
and as thereafter amended, is hereby further amended by changing the designation on the
following-described property from the "Low Density Residential' designation to the "Industrial'
designation:
That part of the Northeast Quarter of Section 24, Township 106 North, Range 14
West, Olmsted County, Minnesota, described as follows:
Commencing at the northeast corner of said Northeast Quarter; thence South 89
• degrees 50 minutes 44 seconds West, assumed bearing, along the north line of
said Northeast Quarter, 1054.84 feet for the point of beginning; thence South 00
degrees 09 minutes 16 seconds East, 1145.18 feet to the northerly right of way
of Trunk Highway No. 52 as defined on State Highway Right of Way Plat No. 55-
2 (the next three courses are along said northerly right of way line); thence South
82 degrees 20 minutes 14 seconds West, 132.69 feet; thence South 83 degrees
42 minutes 34 seconds West, 1285.14 feet; thence South 89 degrees 53
minutes 02 seconds West, 147.20 feet to the west line of said Northeast Quarter;
thence North 00 degrees 29 minutes 08 seconds West, along said west line,
1299.81 feet to the northwest corner of said Northeast Quarter; thence North 89
degrees 50 minutes 44 seconds East, along said north line, 1564.04 feet to the
point of beginning.
Said Parcel contains 44.105 acres, more or less
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained
in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
• Minnesota.
