RESOLUTION
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, the City of Rochester initiated an amendment to the Rochester Urban
Service Area Land Use Plan to change the designation of approximately 27.61 acres of land
• from "Recreation Area/Open Space" to "Medium Density Residential" and approximately 8.85
acres of land from "Recreation Area/Open Space" to "Commercial." The property is located
south of Highway 14 East and north of Eastwood Road S.E.; and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended approval of the proposed amendment to the City's
"LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on July 18, 2005, on the matter of the proposed
amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Recreation Area/Open Space" designation to the "Medium Density
Residential" designation:
Part of the South Half of the Southwest Quarter, Section 5, and part of the
• Southeast Quarter of the Southeast Quarter, Section 6, all in Township 106
North, Range 13 West, Olmsted County, Minnesota, described as follows:
Beginning at the southeast corner of said Section 6, thence westerly on a
Minnesota State Plane Grid Azimuth from north of 269 degrees 21 minutes 40
seconds along the south line of said Soutb ahstQuarter 442.88 feet; thence `,may

northerly 358 degrees 52 minutes 11 seconds azimuth 1317.84 feet to the north

northeasterly, having a radius of 450.00 feet and a central angle of 52 degrees
37 minutes 00 seconds; thence easterly 93 degrees 57 minutes 27 seconds
azimuth 249.67 feet; thence easterly 222.33 feet on a tangential curve concave
southerly, having a radius of 500.00 feet and a central angle of 25 degrees 28
minutes 40 seconds; thence southeasterly 199 degrees 26 minutes 07 seconds
azimuth 121.49 feet; thence southwesterly 209 degrees 26 minutes 08 seconds
azimuth 179.91 feet to the south line of said South Half; thence westerly 270
degrees 26 minutes 11 seconds azimuth along said south line 1314.89 feet to
the point of beginning.
Containing 27.61 acres, more or less.
BE IT FURTHER RESOLVED that the "LAND USE PLAN" as adopted on March 24,
01980, and as thereafter amended, is hereby further amended by changing the designation on
the following-described property from the "Recreation Area/Open Space" designation to the
"Commercial" designation:

West, Olmsted County, Minnesota, described as follows:

office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
