HomeMy WebLinkAboutResolution No. 356-05 E6 • RESOLUTION WHEREAS, Cassidy Hills Land Development and Eugene Cassidy has proposed the filling of 0.35 acres of Type 2 wetland on property located east of Highway 63 east of Stonehedge and north of Century High School, and north of East Circle Drive. The wetland areas are sidehill Decorah Edge-related wetlands. The six wetlands proposed to be filled (a total of 0.35 acres) is due to the required location of streets and related residential lots, and the probable loss of hydrology that supports the wetland. The applicant proposes direct replacement east of the Cassidy Hills plat through creation of 0.40 acres of new wetland adjacent to the Stonehedge calcareous fen. The applicant also proposes direct replacement of 0.25 acres of new wetlands and 0.20 acres of buffer on the Cassidy property adjacent to an existing wetland. The total wetland replacement is at a 2:1 replacement ratio or 0.7 acres. The plan provides for over 0.85 acres of new wetlands and buffer; and, WHEREAS, the Technical Evaluation Panel (TEP) reviewed the application and •recommended approval; and, WHEREAS, this matter came before the City of Rochester Common Council on August 1, 2005, for a final decision on the replacement plan. The Council gave all interested parties an opportunity to be heard on this matter and considered all information presented to it including that information found within the Council Agenda packet. NOW., THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by Cassidy Hills Land Development and Eugene Cassidy for the development of the Cassidy Hills Subdivision. BE IT FURTHER RESOLVED that this approval is subject to the following conditions: 1. The applicant must provide a Declaration of Restrictions and Covenants for Replacement wetland document covering the replacement areas as required by wetland rules. 2. The applicant must supply an annual monitoring plan until the wetland areas are accepted by the Technical Evaluation Panel. • The Mayor and the City Clerk are authorized and directed to approve this plan on behalf • of the City.
