HomeMy WebLinkAboutResolution No. 468-05 t RESOLUTION WHEREAS, the Common Council of the City of Rochester by enactment of Resolution 143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive municipal plan for the City of Rochester, Minnesota, and environs; and WHEREAS, the City of Rochester initiated an amendment to the Rochester Urban Service Area Land Use Plan to change the designation of approximately 2.53 acres of land from • "Low Density Residential" to "Medium Density Residential" and approximately 65.70 acres of land from "Low Density Residential" to "Commercial." The property is located north of Overland Drive N.W., and east of Highway 52; and, WHEREAS, the Planning and Zoning Commission of the City of Rochester, after published notice and hearing, recommended approval of the proposed amendment to the City's "LAND USE PLAN;" and WHEREAS, the Common Council, after published notice, held a public hearing in the Council/Board Room of the Government Center on September 19, 2005, on the matter of the proposed amendment to said "LAND USE PLAN;" and WHEREAS, the Council determined that the Applicant satisfied all of the criteria applicable to amendments of Land Use Plans. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter amended, is hereby further amended by changing the designation on the following-described property from the "Low Density Residential" designation to the "Medium Density Residential" designation: That part of the West Half of the Southeast Quarter and part of the Southwest • Quarter of Section 4, Township 107 North, Range 14 West, Olmsted County, Minnesota, described as follows: Commencing at the northeast corner of said Southeast Quarter; thence South 89 degrees 11 minutes 08 seconds West, assumed bearing, along the north line of said Southeast Quarter and Southwest Quarter, 2722.43 feet; thence South 00 • degrees 00 minutes 00 seconds East, 91.67 feet; thence South 55 degrees 49 minutes 26 seconds East, 221.77 feet; thence South 00 degrees 00 minutes 00 seconds East, 207.11 feet; thence South 25 degrees 45 minutes 15 seconds West, 148.47 feet; thence South 00 degrees 00 minutes 00 seconds East, 143.27 feet; thence South 56 degrees 07 minutes 27 seconds East, 104.40 feet for the point of beginning; thence South 43 degrees 39 minutes 24 seconds West, 217.15 feet; thence South 00 degrees 00 minutes 00 seconds East, 349.66 feet; thence North 90 degrees 00 minutes 00 seconds East, 240.00 feet; thence North 00 degrees 00 minutes 00 seconds East, 308.74 feet; thence northeasterly 107.79 feet along a tangential curve, concave southeasterly, central angle of 61 degrees 45 minutes 35 seconds, radius of 100.00 feet and the chord of said curve bears North 30 degrees 52' minutes 48 seconds East; thence North 28 degrees 14 minutes 25 seconds West, 25.00 feet; thence North 56 degrees 07 minutes 27 seconds West, 157.72 feet to the point of beginning. Containing 2.53 acres, more or less. BE IT FURTHER RESOLVED that the "LAND USE PLAN" as adopted on March 24, 1980, and as thereafter amended, is hereby further amended by changing the designation on the following-described property from the "Low Density Residential" designation to the "Commercial" designation: • That part of the West Half of the Southeast Quarter of Section 4, Township 107 North, Range 14 West, Olmsted County, Minnesota, described as follows: Beginning at the southeast corner of the West Half of said Southeast Quarter; thence South 89 degrees 26 minutes 48 second West, assumed bearing, along the south line of said Southeast Quarter, 436.18 feet; thence North 06 degrees 39 minutes 31 seconds East, 141.19 feet; thence northerly 220.62 feet along a tangential curve concave westerly, central angle of 42 degrees 08 minutes 06 seconds radius of 300.00 feet and the chord of said curve bears North 14 degrees 24 minutes 32 seconds West; thence North 54 degrees 31 minutes 24 seconds East, not tangent to said curve, 28.37 feet; thence North 78 degrees 38 minutes 04 seconds East, 458.53 feet to the east line of the West Half of said Southeast Quarter; thence South 00 degrees 06 minutes 11 seconds East along said east line, 451.75 feet to the point of beginning. BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the office of the Director of Public Works of the City of Rochester; and the office of the Director of Building and Safety of the City of Rochester and shall be available for public inspection.
