HomeMy WebLinkAboutResolution No. 498-05 E4' RESOLUTION WHEREAS, Think Federal Credit Union applied for an Arboretum Special District Project Development Plan #05-03 to permit the operation of a credit union branch office with a drive through facility to be located on Lot 1, Block 1, Think,Plaza along the east side of West Circle Drive and north of Members Parkway N.W.; and, WHEREAS, the proposed development is subject to the provisions of Ordinance #2247, which establishes the Arboretum Special District and provides for procedures for approval of projects within the Special District. In this instance, A Type 111, Phase 11 review procedure is necessary for both the project development plan phase and the final development plan phase of the review. This requires public hearings at both the Planning Commission and the City Council. According to the R.C.O. §60.327, this application will need to be measured against the criteria applicable for conditional use permits (Section 61.146) and also for a Restricted Development Preliminary Plan (Section 62.708); and, WHEREAS, with respect to R.C.O. §61.146 and assuming this application were approved subject to conditions or modifications, the Planning Department staff suggests that findings within this Section could not be made to support denial of this request; and, WHEREAS, R.C.O. § 62.708 (Criteria for Type III Developments) provides the relevant • criteria for the review of this application; and, WHEREAS, the Planning Department applied the criteria found at Section 62.708 to this application and prepared the following findings of fact: 1) Preliminary Development Plan Criteria: a) Capacity of Public Facilities: The existing or future planned utilities in the area appear adequate to serve the proposed development. Sewer, water and electricity are directly available to this site. The static water pressures within the area will range from the low to mid 60's PSI. The water system will need to be looped and public easements will need to be dedicated per the requirements of RPU. b) Geologic Hazards: There are no known geologic hazards, associated with the development of this site. c) Natural Features: The proposed development is out of the 100 year flood plain however development is proposed with the shoreland area. A maximum of 25% of impervious surface coverage is permitted in the shoreland area. The applicant is proposing 24% of impervious surface coverage. d) Residential Traffic Impact: This development is not expected to generate any appreciable amount of traffic within residential areas. Nottingham Drive NW and Members Parkway NW is a major local street that were designed and planned to carry neighborhood trips from the Lincolnshire area to the West Circle Drive corridor. e) Traffic Generation Impact: Anticipated traffic generated by the proposal is not expected to exceed the capacity of adjacent streets. f) Height Impacts: The proposed height of the structure is one story. g) Setbacks: Setbacks from the external project boundaries exceed those that would be required in a commercial zoning district in the City. h) Internal Site Design: For development involving new construction, the preliminary site layout indicates adequate building separation and desirable orientation of the buildings to open • spaces, street frontages or other focal points. i) Screening and Buffering: Individual site landscaping will need to be identified with the Final Plan application for each site. j) Ordinance Requirements: The proposed development includes adequate amounts of off-street parking and loading areas. It appears the drive-up lanes provide the required vehicle stacking, however, the final plan will need to include vehicle stacking dimensions. The applicant will need to provide a complete site capacity evaluation with the final plan application. k) General Compatibility: The building orientation, height and size appear compatible with the surrounding uses; and, WHEREAS, on September 14, 2005, the Rochester Planning and Zoning Commission held a public hearing on this restricted development preliminary plan, reviewed the application according to the requirements of Section 62.708, adopted the Planning Department's recommended findings of fact and recommended approval of the application subject to the following conditions: 2 • 1. Separate grading and drainage plan approval and permit are required. 2. Pedestrian Facilities are required along the frontages of the Property as specific in the Development Agreement. 3. The water system shall be looped and public easements dedicated per the requirements of RPU. 4. The Final Site Plan should include: A. Completed site capacity calculation for the property and data identifying the total site area, proposed Floor Area Ratio and Landscape Area for the project shall be noted on the site plan. B. Final building design, building elevations, materials and colors, landscaping, and sign detail. C. Stacking requirements for the drive through lanes. WHEREAS, the Common Council held a public hearing on the restricted development preliminary plan request on October 3, 2005, and permitted all interested persons to be heard; • and, WHEREAS, based upon a preponderance and substantial weight of the evidence submitted at the October 3rd public hearing, the Common Council determines that the Applicant satisfied the criteria of Section 62.708 if the above conditions were satisfied. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the Arboretum Special District Project Development Plan (Preliminary Plan) #05- 03 requested by Think Federal Credit Union is in all things approved subject to the above four conditions. 3 PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS DAY OF n' ffmE:�' , 2005.
