• RESOLUTION WHEREAS, Wood Lake Enterprises of Rochester applied for a variance from the requirements of R.C.O: Sections 64.310 and 64.331 as to a storm water pond located on property south of Highway 52 and east of Wood Lake Drive S.E:; and, WHEREAS, the applicant seeks the variance because the applicant wants the existing pond on the property to be accepted by the City,as a storm water management pond although the pond does not meet city, state and federal design standards. The pond is approximately 35- feet deep in some areas while the design standard for a storm water management pond calls for a maximum depth of ten feet. In addition, the existing pond exceeds the permitted side slopes; and WHEREAS, Section 60.417 of the Rochester Code of Ordinances provides the criteria by which a variance request is analyzed; and, WHEREAS, this matter came before the Rochester Zoning Board of Appeals at its October 5, 2005, meeting; and, WHEREAS, the Zoning Board of Appeals made the following findings of fact: 1. EXCEPTIONAL CIRCUMSTANCES: There do not appear to be exceptional circumstances 'that apply to this development that do not apply to other developments. The City has an MS4 Stormwater Permit which requires that certain design standards for stormwater ponds be followed in addition to the MPDES Phase 2 Stormwater Permit requirements for private developers of lots 1.0 acre or larger. The pond/lake was created by the owner by fill being removed from the site in order to create buildable. pads for the lots within the development. In other words, the applicant created the hardship by grading the property in the manner in which he did. The owner has recorded an Amended and Restated Maintenance & Ownership Declaration on July 12, 2005. The Declaration states, "Wood Lake agrees the storm water facility does not currently meet the City's standards for design Wood Lake agrees that it will make efforts as each lot is developed to correct design deficiencies and complete .the necessary medications within 4 years." The Declaration recorded by the owner already requires that the owner bring the facility into compliance with the design standards for storm water management facilities. 2. REASONABLE USE: The variance isn't necessary to permit the reasonable use of the property. The existing pond could be filled in so that it met the design standards for storm water management ponds and/or the owner could construct pre-treatment ponds elsewhere within the development that would pre-treat the storm water prior to it reaching the existing nonconforming pond. Another option for the owner would be to pay storm water management charges for the existing • vacant lots and the lots developed since 2002. 3. ABSENCE OF DETRIMENT: Granting of the variance would be materially detrimental to the public welfare. Design standards were developed to protect the public and also limit the potential of pollution. In storm water ponds greater than ten _feet in depth, there is a great likelihood that the ponds will become stratified many times throughout the. year. Stratification of the water bodies results in degradation of water quality during certain times of the year. Also, the side slopes are a public safety concern as side slopes are steeper than the design standards and do not adequately protect the unsuspecting public against the possibility of drowning in a deep, cold water pond with steep slopes; and, WHEREAS, based on the above findings of fact, the Zoning Board of Appeals denied the variance request; and, WHEREAS, this matter was appealed to the Common Council and came before the Council at its November 7, 2005, meeting; and, WHEREAS, at the November 7th public hearing, the Council considered the information presented to it in its council agenda packet (attached hereto as Exhibit A) and determined the applicant satisfied the criteria stated at Section 60.417 if the applicant satisfied the following conditions: • 1. Storm water pond will remain privately owned and maintained until such time as it meets city standards; 2. The applicant shall place an appropriate number of signs around the perimeter of the pond advising persons of the danger and that no swimming is allowed; 3. An as-built plan showing two-foot contours be prepared for the portion of the pond extending a distance of 20 feet from the shoreline or until the depth exceeds ten feet, whichever is a greater distance from the shoreline; 4. The pond outlet control structure shall be installed as shown on the grading plan; 5. Grading of the east side of Lots 1-2, Block 2 and Lot 3, Block 2 be completed concurrent with development of those lots; 6. Payment of the conveyance component of the Stormwater Management Plan Area Charge'for: A. Lot 1 Block 1 WLP First Replat (Top Shop) • B. Lot 2 Block 1 WLP First Replat (Whistle Binkies) 2 • C. Lots 1-2 Block 2 WLP Second D. Lot 3 Block 2 WLP Second E. Lot 2 Block 3 WLP Second (Indoor Soccer Facility) F. Lots 1-3 Block 1 WLP Second (Textile Care) These lots are not eligible for Storm Water Utility Fee Credits; and, WHEREAS, based upon its findings of fact, the Council concluded that the Applicant has satisfied the criteria provided by Section 60.417 and, as such, is entitled to the requested variance subject to the above six conditions. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City grant to Wood Lake Enterprises of Rochester a variance from the requirements of R.C.O. Sections 64.310 and 64.331 as for the depth and slope design of the stormwater pond located south of Highway 52 and east of Wood Lake Drive S.E., (Variance #05-20) subject to the above six conditions. The outcome of the meeting was that the applicant still needed to seek a variance to the two design standards; depth and slope. The applicant addressed the pond depth issue in the letter dated October 5, 2005 to John Wellner from the Polaris Group but still needs a variance to the City's design standards. In addition, the applicant graded without a grading permit but was able to grade in the 10:1 bench for a width of 10 feet below the normal water level; however, the next 10 feet are not graded at a 3:1 slope. Rochester Zoning Board of Appeals Action: On October 5, 2005, the Rochester Zoning Board of Appeals denied the variances requested of the applicant, Wood Lake Enterprises of Rochester, for property located south of TH 52 and east of Wood Lake Drive SE. When the reviewing body modifies or renders a decision that reverses a decision of the zoning administrator or hearing body, the body must set forth its findings and state its reasons for its action. Room 108 Rochester,MN 55904-3740 RE:Review of Water Quality Basin Effectiveness,Wood Lake Industrial Park Revision to September 30,2005 letter Dear John: This letter addresses technical issues related to the effectiveness of the proposed water quality pond for the Wood Lake Industrial Parkin Rochester,MN. This letter revises our September 30,2005 letter regarding this matter. The intention is to respond to your request for an evaluation of the effectiveness of this pond and the e-mail from the MPCA regarding the effectiveness of water quality treatment in water bodies over 10 feet deep. The drainage area tributary to the basin is approximately 120.acres. The City of Rochester has indicated that the portion of the watershed that requires treatment is the Wood Lake Industrial Park. A water • quality pond that would meet the City and MPCA's NPDES requirements for the entire Wood Lake Industrial Park would have a dead storage volume on the order of 8 acre-feet. A water quality pond that would meet the City and MPCA's NPDES requirements for the entire watershed would have a dead storage volume on the order of 14 acre-feet..The bottom of the existing basin is between 18 and 34 feet deep(City.of Rochester,Department of Public Work,Wood Lake Park Pond). It has a surface area of approximately 9 acres and provides an estimated dead storage volume between 150 and 175 acre-feet. Basin Depth The MPCA's NPDES General Permit standard indicates that the pond depth should not be greater than 10 feet. The e-mail from Michael Findorf provides the MPCA's justification for adopting the 10 foot depth standard and indicates concerns with deeper ponds. This discussion raises legitimate general concerns. Summarized below are site specific reasons we believe the existing Wood Lake basin adequately meets the intent of the NPDES regulations and provides an equivalent or better water quality treatment. One concern that was raised in the MPCA e-mail is that the pond will"stratify many times throughout the year",resulting in anoxic.hypolimnetic conditions which release phosphorous from the sediments. "Internal phosphorous loading"and the resulting algae blooms can be a problem when phosphorous is repeatedly released from the sediments and brought via wind driven currents to the photic zone. This problem is a concern in ponds and natural water bodies that have a depth of 10 to 15 feet and in-place organic sediments. Cedar Lake in Scott County is an example of a natural water body for which this is a problem. Cedar lake is between 10 and 15 feet and wind and waves periodically agitate the entire water Mr.John Wellner October 5,2005 Page 2 • column. The 10 foot depth requirement is meant to ensure that a pond will remain aerobic through its entire water column,thus any precipitated phosphorous will remain in the sediments. The MPCA 10-foot depth standard seems the most appropriate if the*sole purpose of a constructed pond is to be used to improve water quality. A water quality pond would not likely be constructed so large and deep. The Wood Lake basin has been constructed much deeper and larger than required for a sole purpose water quality pond. As further described below,we believe that the basin's depth and general lack of organic sediment will not result in repeated stratification and de-stratification and the resulting "phosphorous pump"or"internal loading"will not occur. Depth- The basin is relatively deep and small. Because of its depth and size we believe,based on our experience and discussions with other water quality experts,(Tim Hoyman,limnologist with Onterra Ecological Serves and Dr.Heinz Stefen,Professor with'the University of Minnesota Civil Engineering Department),that it will develop a stable thermal stratification during the summer and will not de-stratify "many times throughout the year". Any phosphorous or pollutants that are released from the sediments in the anoxic hypolimnion,will be contained in the hypolimnion throughout the summer. During fall turnover, an algae bloom could occur,however,the biological activity should be somewhat muted because of the cool water temperature(approximately 40 degrees). Typically the pond is at low levels during the fall with no discharge and dissolved phosphorous is expected to remain in the pond. Eventually;the phosphorous will be recaptured by algae or bound by other chemical means in the aerobic waters following turnover and will precipitate out of the water column. The stratification and mixing 1 or 2 times occurs year per naturally in most Minnesota lakes of similar • P Y Y depth. The table below summarizes water bodies in Minnesota with'a similar depth to the Wood Lake basin(from attached Table 2,Water on the Web). The complete list of Minnesota lakes in the published reference is attached. The Wood Lake basin has a maximum depth of 11 meters and a surface area of 9 acres. As the table above indicates,small water bodies with a similar depth may never mix(Brownie Lake and Deming Lake),or may mix 1 or 2 times per year(Lake Independence,Pike Lake,or Ice Lake). This reference suggests that shallow lakes or ponds will tend to periodically mix if they are less than 4 meters(13 feet). As we mentioned above, our belief that periodic mixing of the lake will not occur is based on our experience,our discussions with other water quality professionals, and our comparison to similar lakes. We believe this could be verified through stratification modeling of this basin using MINLAKE(Riley and Sefan, 1987,"Dynamic Lake Water Quality Simulation Model"MINLAKE", LCMR, Project Report No.263)or a similar model. Organic Sediments- Over time organic sediments will build up and could provide a phosphorous source if the depth is reduced to 15 feet or less. Given the basin size it will be a substantial length of time before this is occurs. It is estimated that the period of time is in excess of 600 years assuming industrial development in the entire watershed and sediment buildup rates published the City's Stormwater Management Plan(Table 6-1). Like any water quality basin,the Wood Lake basin will require maintenance to remove sediment. Given its depth and size,we expect less frequent cleaning of this basin compared to a typical"NURP"type pond. If internal loading from the sediment occurs in the future,periodic algal blooms will occur. At that time the problem could be addressed by treatments(e.g.alum)to bind the phosphorous at the basin bottom,aeration to prevent stratification and encourage mixing throughout the water column,or dredging/excavation of the basin to remove sediments and deepen it to encourage stratification. Safety Karl Schuller will be addressing safety concerns with the basin by modifying the side slopes. Please contact Karl if you need additional information on this issue. Groundwater The normal elevation of the basin(elevation of the outlet)has been set to 1030.1 which represents the basin's typical water level as shown on the City's topographic map. This elevation also represents the approximate level of water in Willow Creek and should represent the regional groundwater level in this area. Since the basin's normal elevation is similar to the groundwater level,the basin is not expected to result in impacts due to stormwater contribution on groundwater including changes in the direction of flow or quality of groundwater. We are not aware of a drinking water supply management area near the basin. A search of wells within a quarter of a mile of the basin(Minnesota Department of Health,County Well Index Online, http://mdh-agua.health.state.mn.us/cwi/cwiViewer.httn)identified 5 domestic water supplies and a monitoring well. The closest well is approximately 2,000 feet from the basin. The water supply wells are between 200 and 517 feet deep and do not draw water from the surficial layer. • Mr.John Wellner October 5,2005 Page 4 • Overall Effectiveness of Stormwater Management Options A permanent detention pond meeting the specific requirements of the MPCA's NPDES program is just one example of a practice to improve water quality. Because of its size,the Wood Lake basin is capable of improving not just the stormwater quality of the Wood Lake Industrial Park that requires treatment,but the entire 120 acre watershed. This basin is large enough to treat the entire 120 acre watershed to meet State and City water quality objectives with no other stormwater treatments. An alternative stormwater pond that would be sized to meet the minimum treatment requirements for this site would not be nearly as effective at improving the watershed's discharges to Willow Creek. Also,because of the limited space between the Wood Lake Industrial Park and the Willow Creek floodway,other alternatives that would utilize funds contributed to the City's Stormwater Management Fund do not appear to be feasible at improving the water quality from this watershed. It is myis understanding that the applicant,was going to provide information to the City Engineer on what effects the stormwater contribution will have on the groundwater. If the effects of surface water/ groundwater interactions are negligible to the groundwater, the City Engineer will support a waiver of the 10 foot deep design standard, however, would not support a waiver to the side slope requirements. To date no information has been submitted to the City Engineer. The Pond is approximately 35 feet deep in some areas with steep side slopes, both of which constitute deficiencies that do not meet standards for storm water quality treatment ponds. The grading/excavation that has occurred over the past 25 years isn't in compliance with the 1980 Grading Plan approved for the development. In addition, the grading/excavation.activity has resulted in the pond proceeding westerly and is_ now within part of the individual lots adjacent to Outlot A. The owner recorded an Amended and Restated Maintenance & Ownership Declaration on July 12, 2005. The declaration States "Wood Lake agrees the storm water facility does not currently meet the City's standards for design. Wood Lake agrees that it will make efforts as each lot is developed to correct design deficiencies and complete the necessary medications within 4 years." The purpose of the agreement is to guarantee a certain level of maintenance for the private stormwater facility and also gives the City the ability to maintain the facility and charge the owners for the maintenance if the owners did not maintain the facility as required in the agreement. • The maintenance of the storm water facility is important to make sure the operational performance of the facility is functioning as designed. If the facility has not been maintained and the operational performance declines the City and the area are adversely affected by the additional pollutants and sediment. These problems are both an environmental issue and also a regulatory issue for the City's MS4 permit. A new grading plan for the existing pond was required as a condition of the Amended and Restated Maintenance & Ownership Declaration and was submitted to the City Public Works Department on August 5, 2005. On August 23, 2005 the Grading Plan was returned to the owner, not approved, but with a number of corrections needed. In discussions with the public works department the main reason the grading plan is not approval is due to the fact that the slope to the bottom of the pond is proposed at 2:1 not at the 3:1 which is the design standard. Also the depth of the pond is greater than 10 feet. At this time the owner has not resubmitted the grading plan. The Storm Water Management Plan (SWMP) was adopted by the City in 1997 and revised in 1999. The SWMP includes the Woodlake Park pond and indicates that water quality treatment will occur in that pond, and as such the pond must be designed and constructed to meet the water quality treatment • requirements of the SWMP. The SWMP does provide some guidance as to Page 2 of 7 • desigh.standards for stormwater ponds. However, for the most part the stormwater pond design standards that the developer is requesting a variance from are. standards established.by the EPA / MPCA and are applicable to owners/developers of lots .1.0 acres or larger under the federal NPDS Phase 2 Stormwater Permits. What this means is that the owner is seeking a variance from the City to a MPCA design standard that the City is required to follow under the City's MS4. Stormwater Permit. ` The operative question to ask is; How can the City grant a variance to federal or state storm water facility_design standards? If the variance is granted, the pond would not meet federal/MPCA water quality standards and the City could be required, at its cost, to mitigate at a different location the impact of the loss of water quality treatment in this pond. If a Variance is granted by the city, the city should not accept ownership of the pond and the associated liability for a stormwater pond that does not meet standards intended to provide water quality treatment and safety from possible drowning. ANALYSIS: The applicant is requesting a variance to Sections 64.310 and 64.331 of the • Rochester Zoning Ordinance and Land Development manual. The applicant states "The lake/retention pond in Wood Lake Park has been constructed over the past 25 years. The depth and interior slope exceeds the retention pond present design. It is a beautiful clear Fake now and to fill it in makes no common sense.,, Basically the owner is requesting that the existing pond be accepted as a storm water management pond even though the ponds do not meet city, state and federal design standards. Section 64.310 and 64.331 of the City of Rochester Zoning Ordinance and LDM {LDM}, Rules for stormwater runoff (shown below), describes how developments shall be designed to control storm water runoff drainage flows. Please note Paragraph 64.310 below deals with the volumes of stormwater runoff to be handled by storm sewers and is not germane to the water quality treatment deficiencies of the Woodlake Park stormwater pond. .64.310 STORMWATER RUNOFF: Increases in runoff from the 10 year and 100 year frequency storms due to development,shall be detained within.the development and released at a rate no greater than existed prior to.the development unless • otherwise permitted by the City Engineer. Storm sewers normally shall be designed for a 10 year frequency storm, however; sewers designed to Page 3 of 7 a greater frequency storm may be required where safer overland flow . routes to requiring waters or major drainage facilities or.collector systems are provided in a manner consistent with the Stormwater . Management Plan. Greater runoffs may be permitted by the City Engineer if downstream stormwater management facilities are adequate for the conveyance or if the development is adjacent to a receiving body of water such as a lake or river and proposed runoff is consistent with the Stormwater Management Plan. 64.331 Positive Drainage Required: Developments shall be designed and constructed with a positive drainage flow away from buildings towards approved drainage facilities. Plans for drainage facilities shall be approved by the City Engineer. All interim and permanent drainage facilities shall be designed and constructed in accordance with the standards established in the City's Stormwater Management Plan and the stormwater runoff standards in Section 64.310. Therefore, the applicant requests: • a variance to the maximum 10 foot depth of a storm water • management water quality pond below the normal water elevation. • a variance to side slope requirements of 10:1 and 3:1 for a stormwater management pond. Basically the owner is requesting that the existing pond be accepted as a storm water management pond even though the pond does not meet city, state and federal design standards. The Planning staff suggested findings are: EXCEPTIONAL CIRCUMSTANCES: There does not appear to exceptional circumstances that apply to this development that does not apply to other developments. The City has a MS4 Stormwater Permit which requires that certain design standards for stormwater ponds be followed in addition to the NPDES Phase 2 Stormwater Permit requirements for private developers of lots 1.0 acre or larger. The pond/lake was created by the owner by fill being removed from the site in order to create buildable pads for the lots within the development. In other words the applicant created the hardship by grading the property in the manner they did. The owner has recorded an Amended and Restated Maintenance & Ownership • Declaration on July 12, 2005. The declaration States "Wood Lake agrees the storm water facility does not currently meet the City's standards for design., Page 4 of 7 Wood Lake agrees that it will make efforts as each lot is developed to correct • design deficiencies and complete the necessary medications within 4 years." The Declaration recorded by the owner already requires that the owner brings the facility into the compliance with the design standards for storm water management facilities. REASONABLE USE: The.variance isn't necessary to permit the reasonable use of the property. The existing pond could filled in so that it met the design standards for storm water management ponds and/or the owner could construct pre-treatment ponds elsewhere within the development that would pre-treat the storm water prior to it reaching the existing nonconforming pond. Another option for the owner is to pay storm water management charges for the existing vacant lots and the lots developed since 2002. . ABSENCE OF DETRIMENT: Granting of the variance would be materially detrimental to the public welfare. Design standards were developed to protect the public and also limit the potential of pollution. In storm water ponds greater than 10 feet in depth there is a great likelihood that the ponds will become stratified many times throughout the year. Stratification of water bodies results in degradation of water quality during certain times of the year. Also the side slopes are a public safety concern as side slopes are steeper than the design standards and do not adequately protect the unsuspecting public against the possibility of drowning in a deep, cold water pond with steep slopes. MINIMUM VARIANCE: The minimum variance that would be necessary to alleviate the alleged hardship would be,variances to design standards that would .allow for a storm water quality pond depth greater than 10 feet and side slopes steeper than 10:1 and 3:1. This finding would not pertain in the case of denial. If the variance is granted, the pond would not meet federal/MPCA water Quality Standards and the City could be required, at its cost, to mitigate at a different location, the impact of the loss of water quality treatment in this pond. If a Variance is granted by the city, the city should not accept the pond and the associated liability for a stormwater pond that does not meet standards intended to provide water quality treatment and safety from possible drowning. If the variance is not granted, the owner still has several options available. One option would be to revise the grading plan so that it meets the city, state and federal design standards for a storm water management pond. Another option would be to construct pre-treatment ponds elsewhere • within the development that would pre-treat the storm water prior to the storm water reaching the existing pond. A third option would be for the Pane 5 of 7 owner to pay storm water management charges for the existing vacant lots • and the lots developed since 2002, since the storm water runoff from these newly developed parcels will discharge into the existing non-conforming storm water quality pond and the City could be required, at its cost, to mitigate at a different location, the impact of the.loss of water quality treatment in this pond. The approval authority may grant a variance to the provisions of this ordinance if it finds that: A. there are extraordinary conditions or circumstances, such as irregularity, narrowness, or shallowness of the lot or exceptional topographical or physical conditions which are peculiar to the property and do not apply to other lands within the neighborhood or the same class of zoning-district; B. the variance is necessary to permit the reasonable use of the property involved; C. the variance will not be materially detrimental to the public welfare or materially injurious to other property in the area, is in harmony with the general purpose and intent of this ordinance; and D. the variance as granted is the minimum necessary to provide* . reasonable economic use of the property. The extraordinary conditions or circumstances shall be found not to be the result of an action by the applicant or property owners who have control of the property. In addition, the approval authority shall find that development of the parcel in question cannot be integrated with development of adjacent parcels under the same ownership in such a manner so as to provide for the reasonable economic use of the total site in a manner consistent with the provisions of this ordinance. Subd. 4. In granting a variance, the zoning administrator or the Board may impose such reasonable and appropriate conditions and safeguards as may be necessary to accomplish, to the extent possible under the circumstances, the purposes of the regulations or provisions which are to be varied or modified and to reduce or minimize potentially injurious effects of the variance upon adjoining properties, the character of the neighborhood, and the health, safety, or general welfare of the community. He also indicated that the water level had dropped five feet already. To meet is the MPCA design standard, he would have to fill the lake in so that it was ten feet deep f; or less. He made the point that every lake is a drainage pond. He.stated that he agreed to re-grade the perimeter of the lake thinking that would be adequate.. He also agreed to maintain the lake in the future.. That's what he thought the maintenance agreement entailed. Then the City told him he.had to fill the lake in and he thought it' just didn't make sense to fill'in a beautiful lake'. He added that the agreement didn't specifically state anywhere that he has to fill the lake in. The City is.holding the building permits until he, or the people who bought the lots; agree to pay the storm drainage fee. Mr.'Ohly stated.that.the problem the Board is going.to have is to grant a variance to some rule or regulation they have no{control over. It would have been helpful if the MPCA were at the meeting. He added that the State and :Federal Governments changed the rules, which put the onus on the.Board, Mr. John Wellner, staff of Rochester Public:Works; addressed the Board. .He stated that the Pollution.Control,Agency's:official position is that storm water ponds,must be en feet or less; Thi ruaing came from St. Paul, not the.1ocal office. He discussed the permitting.process. Mr. Atkinson explained that the purpose of the variance request was for permits to be issued. Mr. Ohly asked what the economic impact would be:on the City of Rochester should the Board grant the variance.. Mr. Wellner responded that, at this po'nt, the"pond does not belong to the .City. The pond is'a private facility.".-The Department's. position is that the pond is .not.in compliance with storm water management, therefore,the applicant will have to.bring his facilities into compliance through the::NPDES permit-.requirement.' Discussion ensued concerning a clean water report that did not get to the Board members soon enough for them to review.
