HomeMy WebLinkAboutResolution No. 567-05 • RESOLUTION WHEREAS, Hanson and Younge, LLC, has proposed the filling of 1.21 acres of Type 2 wetlands on property located within the Scenic Oaks Lakeview Subdivision for the construction of a road and necessary grading for the road and stormwater control elements. The road will serve as the main access for this subdivision. The road cannot avoid wetland impacts on the Joint Powers Board property. Other wetlands adjacent to the reservoir are not affected by the proposed development. The applicant proposes to replace the wetlands on the Joint Powers Board land adjacent to the reservoir east of the existing wetland and on-site on the south side of the development at a 2:1 ratio for a total of 2.42 acres of new wetlands; and, WHEREAS, the Technical Evaluation Panel (TEP) reviewed the application and recommended approval subject to the below described conditions;.and, WHEREAS, this matter came before the. City of Rochester Common Council on * November 21, 2005, for a final decision on the replacement plan. The Council gave all interested parties an opportunity to be heard on this matter and considered all information presented to it including that information found within the Council Agenda packet. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the. City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by Hanson and Younge, LLC, for the Scenic Oaks Lakeview Subdivision. BE IT FURTHER RESOLVED that this approval is subject to the following conditions: 1. The applicant must monitor the wetland replacement sites to determine final excavation depths; '2. The grading plan for the subdivision must reflect the findings of the monitoring and recommended final grades for the tow replacement sites; 3. The applicant must monitor the wetland replacement area and submit annual reports until the wetland is established, and for up to five years as required by the rules; and 4. The wetland two areas be covered by separate deed restrictions that are in a form provided by BWSR and recorded by the applicant. Both applications must be • submitted by the applicant and signed by the appropriate landowner. • The Mayor and the City Clerk are authorized and directed to approve this plan on behalf of the City.
