HomeMy WebLinkAboutResolution No. 573-05 r • RESOLUTION WHEREAS, the City of Rochester proposes to reconstruct 11th Avenue N.W., from Sixth Street N.W., to Tenth Street N.W, as proposed State Project Number SP 159-1113-16 and City Project Number 6311-4-05 (J7746); and WHEREAS, Minnesota Rules 8820.9936 (c) requires a minimum curb reaction distance of two feet for four-lane arterials and this project calls for a curb distance of one foot due to physical constraints of the area and the existing development considerations. NOW THEREFORE BE IT HEREBY RESOLVED by the Common Council of the City of Rochester that the City hereby requests a variance from the Commissioner of Transportation concerning the applicability of State Aid Rule 8820.9936 (allowing a one-foot curb reaction distance in lieu of the required two-foot distance) for State Aid Project SP 159-1113-16, Reconstruction of 11th Avenue N.W., from Sixth Street N.W., to Tenth Street N.W. BE IT FURTHER RESOLVED that the City will indemnify, save and hold harmless the State of Minnesota, its agents and employees of and from claims, demands, actions or causes of action arising out of or by reason of the granting of this variance. • PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS ;?J5r DAY OF /M-EWIEf2Z - , 2005.
