RESOLUTION NO.
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, BIG DE Development initiated an amendment to the Rochester Urban
Service Area Land Use Plan to change the designation of approximately nine acres of land
• located south of Overland Drive N.W., and east of Bandel Road N.W., from "Low Density
Residential"to "Commercial;" and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended approval of the proposed amendment to the City's
"LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on January 9, 2006, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Low Density Residential" designation to the "Commercial":
That part of the Northwest Quarter of the Northeast Quarter of Section 9,
Township 107 North, Range 14 West, Olmsted County, Minnesota, described as
follows: -
Commencing at the northwest corner of the Northeast Quarter of said Section 9;
thence South 01 degree 02 minutes 17 seconds East, assumed bearing, along
the west line thereof, 711.83 feet; thence North 88 degrees 57 minutes 43
seconds East, 90.00 feet; thence South 01 degree 02 minutes 17 seconds East,
77.00 feet; thence North 88 degrees 57 minutes 43 seconds East, 60.00 feet to
`` • the east line of Parcel 532M as shown on MINNESOTA DEPARTMENT OF
TRANSPORTATION RIGHT OF WAY PLAT NO. 55-65 for the point of
beginning; thence continue North 88 degrees 57 minutes 43 seconds East,
110.00 feet to the most northerly corner of Lot 7, Block 5, BANDEL NORTH
FIRST (the next six courses are along the northerly and westerly lines of said
BANDEL NORTH FIRST); thence South 50 degrees 07 minutes 24 seconds
East, 55.53 feet; thence North 27 degrees 43 minutes 30 seconds East, 90.30
feet; thence North 45 degrees 07 minutes 16 seconds East, 180.24 feet; thence
North 67 degrees 20 minutes 39 seconds East, 179.36 feet; thence North 88
degrees 30 minutes 17 seconds East, 87.40 feet; thence North 01 degree 29
minutes 43 seconds West, 557.93 feet to the north line of the Northeast Quarter
of said Section 9; thence South 88 degrees 41 minutes 11 seconds West, along
said north line, 525.09 feet to the east line of said Parcel 532M (the next six
courses are along said east line); thence South 01 degrees 18 minutes 26
seconds East, 50.00 feet; thence South 88 degrees 41 minutes 34 seconds
West, 25.25 feet; thence South 43 degrees 49 minutes 38 seconds West, 70.88
feet; thence South 01 degrees 02 minutes 18 seconds East, 158.93 feet; thence
North 88 degrees 57 minutes 42 seconds East, 25.00 feet; thence South 01
degree 02 minutes 18 seconds East, 530.51 feet to the point of beginning.
Containing 9.00 acres, more or less.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained
• in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
