RESOLUTION NO. 0,Z8-O(o
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, the City of Rochester Common Council initiated an amendment to the
Rochester Urban Service Area Land Use Plan to change the designation of land located west of
• Highway 52, south of 65th Street N.W., and along 34th Avenue N.W. from "Low Density
Residential"to "Commercial;" and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended approval of the proposed amendment to the City's
"LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held ,a public hearing in the
Council/Board Room of the Government Center on January 9, 2006, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Low Density Residential" designation to the "Commercial":
That part of the Northwest Quarter of the Northeast Quarter and of the
Northeast Quarter of the Northwest Quarter, all in Section 9, Township 107
North, Range 14 West, Olmsted County, Minnesota, described as follows:
• Beginning at the northwest corner of the Northeast Quarter of said Section 9;
thence North 88 degrees 41 minutes 11 seconds East, assumed bearing, along
the north line of said Northeast Quarter, 375.66 feet; thence South 01 degree 18
minutes 49 seconds East, 100.00 feet; thence southwesterly 298.33 feet along a
tangential curve, concave westerly, central angle of 56 degrees 58 minutes 38
• seconds, radius of 300.00 feet, and the chord of said curve bears South 27
degrees 10 minutes 30 seconds West, 286.19 feet to a point feet to a point of
reverse curvature; thence southwesterly 443.22 feet along a reverse curve,
concave easterly, central angle of 47 degrees 33 minutes 15 seconds, radius of
534.02 feet, and the chord of said curve bears South 31 degrees 53 minutes 11
seconds West, 430.61 feet; thence South 88 degrees 57 minutes 43 seconds
West, 6.79 feet to a point on the west line of said Northeast Quarter distant
711.83 feet southerly of the northwest corner thereof; thence North 01 degree 20
minutes 17 seconds West, along said west line, 13.63 feet; thence South 85
degrees 02 minutes 29 seconds West, 31.00 feet to the southeast corner of
STUVE'S SECOND SUBDIVISION (the next two courses are along the east line
of said STUVE'S SECOND SUBDIVISION); thence northwesterly 528.69 feet
along a non-tangential curve, concave westerly, central angle of 15 degrees 51
minutes 39 seconds, radius of 1909.86 feet, and the chord of said curve bears
North 19 degrees 55 minutes 46 seconds West, 527.01 feet; thence north 27
degrees 51 minutes 36 seconds West, tangent to said curve, 55.04 feet to the
south line of MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF
WAY PLAT NO. 55-62; thence North 88 degrees 18 minutes 38 seconds East,
along said south line, 3.19 feet to the southeast corner of said right of.way plat;
thence North 01 degree 41 minutes 22 seconds West, along the east line of said
right of way plat, 150.00 feet to the north line of the Northwest Quarter of said
Section 9; thence North 88 degrees 18 minutes 38 seconds East, along said
• north line, 225.00 feet to the point of beginning.

Lot 2, Block 1 Westgard's First Subdivision
Lot 3, Block 1 Westgard's First Subdivision
Lot 1, Block 1 Stuve's Third Subdivision
Containing 5.73 acres, more or less.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained
in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
