RESOLUTION NO. 078-D(P
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, the City of Rochester Planning and Zoning Commission initiated an
amendment to the Rochester Urban Service Area Land Use Plan to change the designation of
leland located along the east side of St. Bridget Road south of 40th Street S.E., including "Area 4"
as identified in The Gardens General Development Plan #261, from "Industrial" to "Commercial;"
and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended approval of the proposed amendment to the City's
"LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on February 6, 2006, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to amendments of Land Use Plans.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN as adopted on March 24, 1980 and as thereafter.
amended, is hereby further amended by changing the designation on the-following-described
property from the "Industrial" designation to the "Commercial":
All of Outlot G, and part of Lot 1, Block 1, Outlot A, D, and F, THE GARDENS,
according to the plat thereof on file at the County Recorder's Office, Olmsted
County, Minnesota, described as follows:

Beginning at the northwest corner of Outlot C, thence northerly 359 degrees 20
minutes 22 seconds azimuth along the west line of Outlot C, Lot 1, Block 1,
Outlot A and D, for 1645.21 feet, thence northeasterly 43 degrees 57 minutes 44
seconds azimuth for 127.99 feet; thence easterly 89 degrees 45 minutes 30
- seconds azimuth for 595.31 feet; thence southerly 180 degrees 00 minutes 00
seconds azimuth for 771.94 feet; thence westerly 269 degrees 20 minutes 22
seconds azimuth for 446.30 feet; thence southerly 179 degrees 20 minutes 22 '
seconds azimuth for 215.06 feet; thence easterly 89 degrees 20 minutes 22
seconds azimuth for 15.00 feet; thence southerly 179 degrees 20 minutes 22
seconds for 745.00 feet; thence westerly 269 degrees 20 minutes 22 seconds for
245.00 feet to the point of beginning.
Containing 17.33 acres, more or less.
BE IT FURTHER RESOLVED that-a certified copy of this resolution shall be maintained
in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
