RESOLUTION NO. I5 7- ®LP
WHEREAS, the Common Council of the City of Rochester by enactment of Resolution
143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive
municipal plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, Prairie Crossing, LLC, initiated an amendment to the Rochester Urban
Service Area Land Use Plan to change the designation of 75.63 acres of land located west of
Highway 52 and north of 65th Street N.W., from "Low Density Residential"to "Commercial;" and,
• WHEREAS, the Planning and Zoning Commission of the City of Rochester, after
published notice and hearing, recommended approval of the proposed amendment to the City's
"LAND USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on March 20, 2006, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the Applicant satisfied all of the criteria
applicable to an amendment of Land Use Plan.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter
amended, is hereby further amended by changing the designation on the following-described
property from the "Low Density Residential" designation to the "Commercial":
That part of the Southwest Quarter of Section 4, Township 107 North, Range 14
West, Olmsted County, Minnesota, described as follows:
Commencing at the southwest corner of the Southwest Quarter of said Section
4; thence North 00 degrees 09 minutes 28 seconds West, assumed bearing,
along the west line of said Southwest Quarter, 75.01 feet to the northwest corner
of Parcel 531 as depicted on MINNESOTA DEPARTMENT OF
TRANSPORTATION RIGHT OF WAY PLAT NO. 55-65 for the point of
beginning; thence continue North 00 degrees 09 minutes 28 seconds West,
along said west line, 2552.32 feet to the northwest corner of said Southwest
Quarter; thence North 89 degrees 11 minutes 09 seconds East, along the north
line of said Southwest Quarter, 1071.07 feet to the northwest corner of Pleasant
Prairie Cemetery as described in Quit Claim Deed recorded on November 30,
1948 on Page 275 in Book 226 of Deeds in the Office of the Olmsted County
Recorder; thence South 13 degrees 45 minutes 16 seconds East, along the west
line of said cemetery, 625.18 feet to the southwest corner thereof; thence North
76 degrees 14 minutes 44 seconds East, along the south line of said cemetery,
201.00 feet to the west line of Parcel 531 as depicted on MINNESOTA
DEPARTMENT OF TRANSPORTATION RIGHT OF WAY PLAT NO. 55-63 (the
next nine courses are along said west line); thence South 12 degrees 54 minutes
13 seconds East, 26.79 feet; thence South 80 degrees 31 minutes 43 seconds
West, 37.65 feet; thence southerly 191.09 feet along a nontangential curve,
concave westerly, central angle of 03 degrees 56 minutes 19 seconds, radius of
2779.79 feet, and the chord of said curve bears South 07 degrees 30 minutes 07
seconds East, 191.05 feet; thence South 84 degrees 28 minutes 03 seconds
West, not tangent to said curve, 20.00 feet; thence South 05 degrees 31 minutes
57 seconds East, 148.06 feet; thence North 84 degrees 28 minutes 03 seconds
East, 20.00 feet; thence South 05 degrees 31 minutes 57 seconds East, 430.00
feet; thence South 03 degrees 38 minutes 21 seconds West, 450.48 feet; thence
South 34 degrees 43 minutes 00 seconds West, 206.77 feet to MnDOT right of
way corner identified as B6318 on said MINNESOTA DEPARTMENT OF
TRANSPORTATION RIGHT OF WAY PLAT NO. 55-63 (the next seven courses
are along the westerly and northerly lines of Parcel 531 as depicted on
• MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY PLAT
NO. 55-65); thence South 34 degrees 43 minutes 00 seconds West, 356.36 feet;
thence South 00 degrees 55 minutes 44 seconds East, 280.52 feet; thence
South 89 degrees 04 minutes 16 seconds West, 90.00 feet; thence North 81
degrees 59 minutes 54 seconds West, 354.30 feet; thence South 89 degrees 04
minutes 16 seconds West, 100.00 feet; thence South 73 degrees 41 minutes 41
seconds West, 207.42 feet; thence South 89 degrees 04 minutes 16 seconds
West, 372.71 feet to the point of beginning.
Containing 75.63 acres, more or less.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained
in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the
office of the Director of Public Works of the City of Rochester; and the office of the Director of
Building and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified
copy of this resolution in the office of the County Recorder in and for Olmsted County,
Minnesota.
