WHEREAS, MSB Holdings — Rochester, LLC, a Minnesota limited liability company, mortgagor,
and LaSalle Bank National Association, a national banking association, mortgagee, owners and
proprietors, have shown to the satisfaction of the City of Rochester Common Council that it has
complied with all conditions of approval imposed upon its Land Subdivision Permit (Preliminary
Plat) and all applicable laws and ordinances;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on April 3, 2006, the following plat of lands
in Olmsted County, Minnesota are to be known and designated as follows:
That part of Lot 1 of Block 1 , except the North 120- feet thereof, Lots 1, 2, and 3 of
Block 2, vacated Pennington Drive N.W., and vacated 23rd Avenue N.W., all in PENNINGTON
BUSINESS .PARK SIXTH SUBDIVISION, according to the plat thereof on file at the, County
Recorder's office, Olmsted County, Mirines&ta, and that part of the. Northeast Quarter ofthe Southeast Quarter of Section 16, Township .107 North, Range 14 West, Olmsted County,
Minnesota, all lying within the -following described parcel of land:
• Commencing at the northwesterly corner .of Lot 5 of said Block 2; the-nce

lime of CIMARROW SIXTEENTH, according to the plat thereof on file at the 'County
