HomeMy WebLinkAboutResolution No. 201-06 • RESOLUTION WHEREAS, on or about October 20, 2003, the Rochester City Council approved Final Plat#02-28 y Denny Peterson to be known as Pine Ridge Estates Fifth Subdivision; and WHEREAS, the approval of Final Plat#02-28 was subject to the following seven conditions: 1. Prior to recording, the final plat shall be revised as follows: i a. Rename the roadway labeled Monterey Drive SW to "Monterey Street SW', b. Change the portion of Red Pine Avenue SW north of the intersection with Redwood Lane SW to "Red Pine Lane SW; c. Rename Woodcrest Lane SW to "Ponderosa Place SW'. � 2. A GIS Impact Fee and E911 Addressing Fee shall be assessed and must be paid prior to recording the final plat, per the September 25, 2003 memorandum from Rochester-Olmsted Planning Department— GIS Division. ¢ I 3. Parkland dedication shall be met as outlined in the September 18, 2003 memorandum from Rochester Park and Recreation Department. ` 4. The applicant shall provide surety that guarantees the site will be fully restored after the • completion of the excavation activity. Said surety must be provided prior to commencement of grading activities on the property. 5. Prior to the issuance of building permits for any lots within this plat, the secondary access to serve the development shall be constructed and approved by the City Engineer, as stated in the executed Development Agreement. 6. No building permits will be issued for the last ten (10) lots in the Pine Ridge Estates Fifth addition until or unless the final punch list items for the street and utility improvements in the Pine Ridge Estates Fifth Subdivision are completed to the satisfaction of the Public Works Department. 7. The developer would be required to provide a letter of credit or establish an escrow account in the amount of$2000 to assure the maintenance of the secondary access. Public Works is to have access to this funding to maintain the access if the developer does not maintain it adequately. WHEREAS, as of the date of this resolution the developer has failed to construct and have ipproved by the City Engineer the secondary access as required by condition #5 above; and WHEREAS, 23 of the 37 residential lots with Final Plat#02-28 have been sold to private parties who vere unaware of the plat conditions that affect the ability to obtain building permits; and WHEREAS, the City Council would like to release those lots sold to private parties from the "no ping permit" condition but continue that condition upon the lots owned by the developer. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City does hereby release the following described lots from the conditions of approval for Final Plat#02-28 for Pine Ridge Estates Fifth Subdivision: Lots 1,2, 7, 9, 10, 11-21, 24 and 25, all in Block 1 Lots 1 and 2, Block 2 Lot 3, Block 3 Lot 1, Block 5. BE IT FURTHER RESOLVED by the Common Council of the City of Rochester that the following lots remain subject to the conditions of approval for Final Plat#02-28 for Pine Ridge Estates Fifth Subdivision: Lots 3, 4, 5, 6, 8, 22, 23, 26 and 27, all in Block 1 Lots 1, 2 and 4, Block 3 Lots 1, 2 and 3, Block 4. The general public is put on notice that the conditions of plat approval listed above shall remain in place until the developer has complied therewith. • PASSED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINNESOTA, THIS c3 D F , 2006.
