HomeMy WebLinkAboutResolution No. 219-06 RESOLUTION WHEREAS, Badger Hills, LLC, has proposed the filling of 0.41 acres of Type 2 wetlands on property located west of West Circle Drive and north of Valleyhigh Road N.W., The wetland area is located in a draingeway. A portion of the wetland is proposed to be filled due to the location of a connecting street and required stormwater control structures. The road is necessary to provide for connections between the southern and northern portions of the subdivision and to the future 41 st Street N.W.; and, WHEREAS, the applicant proposed direct replacement on-site adjacent to the existing wetland through the creation of a new wetland and upland buffer. The total wetland replacement is at a 2:1 replacement ratio and will exceed the minimum requirement of 0.82 acres by creating 0.35 acres of new wetland credits and 1.78 acres of buffer area on-site and purchasing 0.1 acres off-site from a wetland bank in Olmsted County; and, • WHEREAS, the Technical Evaluation Panel (TEP) reviewed the application and recommended approval subject to the below described conditions; and, WHEREAS, this matter came before the City of Rochester Common Council on May 1, 2006, for a final decision on the replacement plan. The Council gave all interested parties an opportunity to be heard on this matter and considered all information presented to it including that information found within the Council Agenda packet. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by Badger Hills, LLC, for the Badger Hills Subdivision. BE IT FURTHER RESOLVED that this approval is subject to the following conditions: 1. The applicant must provide a Declaration of Restrictions and Covenants for Replacement Wetland document covering the replacement area as required by the wetland rules. The applicant must use the standard form provided by BWSR; 2. The applicant must submit the Withdrawal of Credits form for the purchase of the wetland bank credits to the BWSR. • The Mayor and the City Clerk are authorized and directed to approve this plan on behalf of the City.
