HomeMy WebLinkAboutResolution No. 356-06 t. • RESOLUTION BE IT RESOLVED by the Common Council of the City of Rochester that the City execute a Release for the Maine Street Development Agreement for Lots 1, 2, 3, of Block 1; Lots 6, 7, and 8 of Block 5; Lots 1, 2, 3, 4, 5, 6, 7, 8 of Block 6; and Outlots A, I, and J of the Maine Street Development subject to the following conditions: 1. Payment of outstanding development charges for the release area. 2. Site Development Plan approval with the following provisions of the original development agreement being met including: A. Section 3 — City Owner Contract. This is needed for any public improvement to be constructed. B. Section 4 — Grading and Drainage. A grading plan and drainage report is required prior to any final grading for a specific site plan. C. Section 11 — Real Estate Dedication. This requires the Owner to dedicate necessary land rights including easements and outlots, and outlines the • provisions for conveyance. D. Section 16 — Pedestrian Facilities. Owner is required to construct the necessary pedestrian facilities along the public roadways. E. Section 18 — Landscape Maintenance. This requires the Owner to obtain a revocable permit for any landscape features, lighting, signage, sprinklers which may be within any easements/right of way. F. Section 21 — Permits. Owner is required to obtain all necessary permits for development and construction within the property. G. Section 22 — Conditions of Approval. Owner is bound to adhere to any conditions approved by the City Council for the general development plan, preliminary plat or final plat. • • The Mayor and the City Clerk are authorized and directed to execute the agreement on behalf of the City subject to the satisfactory completion of the above conditions.
