HomeMy WebLinkAboutResolution No. 520-06 j • RESOLUTION WHEREAS, Drywall Supply has proposed the filling of 7.93 acres of Type 2 wetlands on property located east of West Circle Drive and west of UBC, south of the railroad right-of-way and north of the North Frontage Road, TH 14 West. The applicant proposes to replace the filled wetlands with;11.91 acres of new wetland credits and 4.18 acres of public value credits (upland surrounding the new wetland) located in Salem Township within the Zumbro River Watershed; and, WHEREAS, the Technical Evaluation Panel (TEP) reviewed the application and recommended approval subject to the below described conditions; and, WHEREAS, this matter came before the City of Rochester Common Council on October 16, 2006, for a final decision on the replacement plan. The Council gave all interested parties an opportunity to be heard on this matter and considered all information presented to it including •that information found within the Council Agenda packet. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the City approve the Wetland Delineation and Replacement Plan presented by Drywall Supply for its property located east of West Circle Drive and west of UBC, south of the railroad right-of-way and north of the North Frontage Road, TH 14 West. BE IT FURTHER RESOLVED that this approval is subject to the following conditions: 1. The applicant must supply an agreement to the City signed by the applicant and the wetland replacement site property owner that also addresses the responsibilities of the applicant and the landowner (responsibility for construction, monitoring and compliance with the approved plan); 2. The applicant must monitor the wetland replacement site during construction of the. replacement area; 3. The applicant must monitor the wetland replacement area regularly during the growing season and submit annual reports until the wetland is established, and for up to five years as required by the rules and longer if necessary. The first monitoring plan must include an as-built survey of the site; and • 4. The replacement wetland must be covered by a deed restriction that is in a form provided by BWSR and recorded by .the applicant. The application must be submitted by the applicant and signed by the landowner. (This condition will take effect after the replacement wetland has been created and approved by the Technical Evaluation Panel and BWSR.) The Mayor and the City Clerk are authorized and directed to approve this plan, subject to the above conditions, on behalf of the City.
