HomeMy WebLinkAboutResolution No. 610-06 • RESOLUTION A RESOLUTION OF THE CITY OF ROCHESTER REGARDING OBTAINING PERMANENT ELECTRIC SERVICE TERRITORY RIGHTS WHEREAS, the City of Rochester ("City") has the legal authority to own and operate an electric utility providing electricity to its citizens; and, WHEREAS, the City has implemented this authority under the auspices of Rochester Public Utilities ("RP.U") which operates, controls and manages the City's electric utility; and, WHEREAS, the City has undertaken a public project of annexing certain lands into the City and planning to provide City utilities and services for the benefit of the public, including streets, sewer, water, electricity, police, and other City services; and, WHEREAS, the City has an established, 'longstanding practice of providing electric service to all areas annexed into the City; and, WHEREAS, the City has no desire or intention to deviate from the well-established past aractice of providing electric service to all areas annexed into the City; and, WHEREAS, the City has authorized RPU to file a petition with the Minnesota Public Utilities Commission, MPUC Docket No. E299,E132/SA-06-1475, seeking the right to provide electric service to appropriate areas annexed into the City since January 1, 2001, pending a decision on final compensation, often called interim service. This action occurred with the knowledge and at the direction of the Rochester City Council; and, WHEREAS, in that interim service proceeding, a question arose as to the City's intention to seek permanent electric service territory rights to the areas at issue; and, WHEREAS, the City would respond to this question by immediately implementing its intention to seek permanent electric service territory rights to the areas at issue were it not for the timing of the question. Currently, members of the Rochester City Council are attending the National League of Cities Conference in Reno, Nevada. Upon their return to Rochester next week, the Council will immediately begin its three-week long process of adopting its budget for .2007. A number of Council meetings and public hearings are scheduled to occur during the remainder of December. Because of Council's temporary absence from the City, the numerous meetings and hearings scheduled for the remainder of the month as well as the upcoming holidays, time does not allow the Council to immediately take the necessary steps to seek permanent electric service territory rights to the areas at issue; and, • WHEREAS, although time does not permit the Council the ability to formally seek permanent electric service territory rights before the end of 2006, the Council does want to •publicly state its intentions to take those very steps in the very near future. For that reason, the Council adopts this Resolution as to its intention. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the City has every intention to seek permanent electric service rights for the subject annexed areas consistent with its long established policy of providing electric service to all areas annexed into the City. BE IT FURTHER RESOLVED that the Council intends to fully implement its intention to provide permanent electric service to these areas by January 31, 2007.
